hi,
i am on h-4 visa,and my i94 is expired more than 180 days,i.e my husband had i-94 till cotober 2007,but the port of entry stamped on my passport upto2006 october,we dint no about i-94 until we had seenit,it expired more than 180 days,our attorny said to extend it but it has already expired,so we thought to go local uscis and request about the case,we were really teansed about that,next morning we went to local uscis office , the officer was really good person ,just he took my husbands i-94 and my i-94 ,and changed the form with my husbands i-94 untill 2007 oct,by gods grace every thing goes well,so if anybody has the similar problem on h-4 visa just go to local uscis office and explain the problem to the officer.

I spoke with IO on 3rd, initiated SR on 4th, initiated congressional request today i.e. 5th. My Infopass is on 11th. Will complete 10 years in US on 13th. Birthday few days after that. So I guess something should work...ROFL...

I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.
I also believe, we (indians) donot give time to ourselves. Ex. husband, wife, kids all together all the time. No good, give time to yourself, do somtihngs togehter and some things seperately, This will give time to observe life as an individual too.
how many indian go out for just all boys groupings, not many. Why??? how bad it can be, when you just go out kick some dust drink beer if you please, atleast releax.
When i started doing it, it was lot of fun.
Same should be with girls, wives, you all should go out and do things with your friends for a change.

I just renew my passport at Houston, TX. It takes about 3 weeks. After so many tries, I was able to speak with CSR and she told me that it will take 3 weeks (this is standard processing time). I have received my new passport along with the old last week.

Wait for another 2 yrs before you pull the plug.... I also returned back after 9 yrs in May 2009 but came back again in Apr 2010 , trying to Port up from Eb3 to Eb2 by accepting a higher position - this is genuine. The new company will file my PERM anyday ( AD was going on) and I'll leverage my Eb3-I old priority date of Mar 2005 which is CURRENT in EB-2 sector. I'm hopeful.
There are lot of challenges in India after being here for 9-10 years ONLY good thing is they will pay you good money because they will treat you as a 'imported commodity' :)

I don't want to continue with this uncertainity any longer and my children are growing up and I want to move on in my life. Negotiating a good job offer for a good position. Its not that I am going to get my GC in 6 months or let alone in 2 years with a total of more than 8000 people ahead of me. So, I am looking at a minimum of 2 years wait and I do not think its worth waiting any longer. Getting a GC in 3-5 years seems tobe a OK wait, but more than 7 years, I want to use my time in something else more precious. Did not mean to hijack the purpose of this thread, just wrote it because you asked that question.

Well I had called a NY congresswoman when I was stuck in a H1 name check. I found them open and willing to help. She even contacted the FBI.
Well I am just an ordinary person, and the same as everyone here, and not saying I will do everything myself. There are persons who are better skilled at this and know the immigration law better.
Also don't rule out lobbying, I just said we also need something else that should justify our case without a lobby. I'm asking for suggestions or ideas.
I may be new here, If you see my post on the other forum, I'm asking for the creation of an organization with skilled people who will create a new campaign among legal immigrants. Kind of like Grass roots movement.

All you have done is made a phone call to a lawmaker office. Before you start a poll go and meet your lawmaker and learn how to talk to lawmakers. That will be a good start.

My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?

I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.

Great Going needhelp. Dont worry about your speed for now. We will gradually work towards walking more distance and get to 2.5 miles in a few weeks. We can do it.
I did 3.5 miles at lunch. it was 77 degrees outside. so 3 miles of running and 0.5 mile of walking took 36 minutes and a litre of water..had to stay hydrated..Hopefully next time I do it I wont need as many water breaks.
and I completed 10 rounds probably 1.5 miles.. So you know I was going rrreeeaaaally slow. (but it was good enough for me)

I am looking for advice on the strategy for filing the third phase since the PDs for my wife and me have become current. My PD is Feb 2003 (EB2) and my wife's is June 2003 (EB3). My wife and I are on 8-th yr H-1B extensions with approved I-140s. Which strategy makes sense and are they even valid? The objective is to go with a risk-free strategy that gets us the GC in the quickest manner.
1. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for I-485 (AOS) using her PD, with me as dependent.
2. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for Consular Processing using her PD, with me as dependent. OR vice versa.
3. Any other option?

Counsular processing(CP) or AOS is determined according to individual situation. It depends on Job-stability, lot of factors. you should do what works for you after careful evaluation, not hedge your bets by doing 2 applications. Just do one way, either use your PD or your wife's and do one application for I-485. Whichever has the best chance with the lowest rate of RFI. whoever wants to stick around longer in their job (you or wife?) should apply, it will take a year+ for that person to stay in the job before final physical card and then 6 more months. Talk to your attorney.

Hey GCN007, congratulations to you. We are very happy that folks with PD<01/08/05 are getting their long-awaited approvals - India or not, IV members or not. Clearly the wait is frustrating and the relief is boundless and we are happy for those who have found that relief.
But, are extreme metaphors really necessary? I don't think anyone here will be willing to chop off body parts for green cards! :) And I don't think it will give anyone receiving them as much relief/happiness.

They pick up a thread that educates members about advocaccy and pretend to have an argument and completely divert the topic. If people have questions there are better ways to talk to management or core.

Is there any way we can initiate the FBI namecheck/background check right away, so that by the time we apply the 485 this is already moving ahead and hopefully will not be a blocker.... i am just thinking out loud about ways we can streamline this process....anyone? ideas?

I once again plead with all members to meet law makers and send several thousand letters on this. Spending 45 mins on a letter (typing, printing, posting etc) may save 5 years of wait! Please think it over!!!
