My advice to you is to beg, borrow, steal or kill but find a way to file for the I485. The benefits of filing for AOS - specially if you have a spouse who cannot work - far outweigh any short term struggle you may have to endure.

It looks like your organization is the only one doing anything concrete to help legal immigrants. I had trouble finding support on other immigration sites.

Frankly, the chances of getting an EB-2 I-140 approved with your educational background are very bleak to say the least. However, there are always exceptions and I hope you get lucky. Good luck, atleast your employer tried.
I agree the qualifications don't seem strong but shouldn't that have been caught at the labor stage?? or is it at the 140 that they check the educational background??

Same with me!
My children have grown up and are on the verge of aging out, while I am still fighting to find avenues for a new green card application. Jobs are not permanent in the US. Layoffs are a common thing. The immigration processes take much longer than the life of a job. Many people like me end up with unfinished and abandoned immigration process. At the end of 6 years we are able to obtain H1-B visas one year at a time. Provided there is a pending I-140 process. What happens if a I-140 application is denied because of some faulty representation or your employer decides to lay you off?
My question to the senate is. Is this fair? Was it foolish off me to have maintained a legal status and spent so much money for nothing? Perhaps if people like me would have remained in the United States illegally without paying taxes, I might have saved a lot of money and would have been able to apply for a non-immigrant status for a very small fee.
My suggestion to the Senate is:
1. Pass a legislation that protects Legal immigrants who have lived in the United States beyond 6 years, but have been unable to obtain an immigrant status for one thing or the other. Or an H1-B non-immigrant who have come to the country before �9/11� and have stayed in the country through the recession; paid taxes; but because of constant layoffs and half finished immigration processes should be rewarded in this bill. Proofs that immigration processes had been initiated but abandoned because of job changes.
2. Children of Legal non-immigrants who have finished 6 years of stay in the US and are aging out, should be protected, because the state has spent tax money on their education and they have adjusted to a life style and system which will benefit the country. They should not be penalized for no fault of theirs.
3. Children and spouses of H1 Non-immigrants who are educated and can work should be given the opportunity to do so. This way many will legally work and pay taxes. It is a great burden on a single H1-B non-immigrant to be the sole earning member in a family. Currently a dependent of a H1-B is not permitted to work.
4. An I-485 process of immigration should not be cancelled if a pending I-140 is denied. This should be made available once again to the applicant and his or her family if a I-140 process is re-applied within 6 months. It is unfair to make the family file for a I-1485 process once again with additional fees, medical tests, finger printing, work authorization and so on. And it is your obligation to yourself and your family to stand up for your rights and ask congress to legislate and fix the system so that it works the way it was originally intended to work.
4. Personal satisfaction and pride : Just ask a participant of September-2007 DC rally or June-2010 DC advocacy event, how proud and how satisfied everyone was after the effort – not just due to impact – but just because they have stood up and spoken up for their issue.

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
As dates will remain current for a while, and when dates retrogress - my take is they may not retrogress to a degree where backlogged applications are dated. So as approvals keep coming out of BECs the PDs of those backlogged till now may be eligible for filing 485.
This is my take. I write this because I understand your frustrations. The game is not over - I have a feeling that a lot of people will be on EAD status for a while

It was introduced by Kennedy to amend an unfriendly amendment from Jeff Sessions, but its only registered on Thomas. It has not passed and its not a part of the bill that passed the Senate today. It was not even debated.
This is what happened:
Kennedy submitted SA 180(about immigration) in response to amendment SA 143(text unavailable) introduced by Jeff Sessions. Its a parliamentary spat (tit for tat) and eventually both were left untouched. So it can be on thomas, but it has not passed.
Thanks for being alert, but please be careful about such things. Not everything that is on Thomas becomes law or is even debated.
