Hello All,
I have two questions about using EAD and H1B status.
Background:
My GC is in EB3 category. I got my EAD in 2007 and renewing it every year on time. My H1B is also valid with my current employer. I have used advance parole while coming back from India. I don't know if that makes any difference.
Last year I have done some part time (after hours and weekend) work for different employer and got 1099 tax forms.
Q1) Does it mean my H1B is invalid or can I still continue to be in H1B immigration status?
Q2) If I find a new employer who is willing to file labor under EB2 then can I continue the H1B status with the new employer? If not can I work for the new employer using EAD and still start my green card process?
Please advice.

Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..

Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..

LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.

Hi everyone, I applied for H1B last year and my employer said my application was not selected in lottery. This year a different employer is applying for my H1 and the lawyer today told me that I already have an approval and gave me a receipt no. When I checked its status online, its - 'Approval notice sent on 29th August 2007'.
I wonder how this lawyer is saying this is my approval, eventhough I was told by my employer last year that I didn't made through lottery. And now this lawyer is asking for the copy of that approval which I am not at all aware of. If I knew I already have the approval I wouldn't be applying again this year.
How did this lawyer found out about my approval receipt? Is there a provision for them to check? Will it be illegal if my application goes again, with an existing approval. I have never been to USA.
Please suggest, what should I do.

Hi,
Is it true that the old (i.e., July 1st - July 29th) filing fees still apply through July 27th - August 17th? The new fees (which would have been applicable from July 30th) will now be applicable from August 18th, right?
Is this true for I-485, I-765 and I-131 forms?

My congressman's office came back with this response for my query on why my wife's case is pending..not even pre-adjudicated, while I got approved on Sept 3rd from TSC.
according to TSC, your file and your wife�s were separated at time of adjudication and that is what has caused the delay. I�m trying to find out why.
Anything like this happened to anyone. Is there anything that can be done, to recombine the cases. My attorney is not very responsive since he was with my last employer. What are my options? I am worried her case is falling thru the cracks. Without any information on the principal applicant and derivative's case may never get adjudicated.....

The White House plans to try implementing as much new policy as it can by administrative order while stepping up its confrontational rhetoric with Congress after concluding that President Bush cannot do much business with the Democratic leadership, administration officials said.
According to those officials, Bush and his advisers blame Democrats for the holdup of Judge Michael B. Mukasey's nomination to be attorney general, the failure to pass any of the 12 annual spending bills, and what they see as their refusal to involve the White House in any meaningful negotiations over the stalemated children's health-care legislation.
White House aides say the only way Bush seems to be able to influence the process is by vetoing legislation or by issuing administrative orders, as he has in recent weeks on veterans' health care, air-traffic congestion, protecting endangered fish and immigration. They say they expect Bush to issue more of such orders in the next several months, even as he speaks out on the need to limit spending and resist any tax increases.
The events of recent weeks have "crystallized that the chances of these leaders meeting the administration halfway are becoming increasingly remote," said White House spokesman Tony Fratto.
Bush himself has been complaining more and more bitterly about congressional Democrats in recent weeks. In a private meeting yesterday with House Republicans in the East Room of the White House, Bush recalled how he had been able to work with Democrats when he was Texas governor and said he had hoped to find the same relationships in Washington.
"He sort of longs for those days, when both sides were genuinely interested in getting along and getting a deal," said Rep. Adam H. Putnam (R-Fla.), the chairman of the House Republican Conference, who helped organize yesterday's White House meeting, attended by about 150 Republicans.
The president offered more criticism after the session. "Congress is not getting its work done," Bush said. "We're near the end of the year, and there really isn't much to show for it."
House Democratic leaders fired back at Bush with strong rhetoric of their own. "The president wants the same complacent, complicit Congress that was a co-conspirator in a coverup of what was going on in this country," said House Majority Leader Steny H. Hoyer (D-Md.).
Both sides have their own political calculations for digging in, with the White House and Republicans seeking to reestablish their credentials as fiscal conservatives and with Democrats concluding that they are on the right side politically on children's health care and other issues.
On some issues, the White House has become increasingly left out of the legislative process. Bush's objection to any tax increases, for instance, has pushed Republicans in the House and the Senate to pursue their own negotiations over an expansion of the State Children's Health Insurance Program (SCHIP), concluding that a final bill must include a significant tobacco tax increase to offset its cost.
Even as they offer the president public support, some Republicans on the Hill are hinting that they might break with Bush if the price is right. Asked yesterday whether he could support an SCHIP bill that Bush opposes, House Minority Leader John A. Boehner (R-Ohio) suggested that is a possibility. "He has his position. House Republicans have theirs," Boehner said.
While Bush castigated Democrats for lack of productivity, congressional Republicans have had their own reasons for moving slowly. On SCHIP, for example, they have said that both sides could reach a deal if the Democratic leadership would slow down and let negotiations proceed.
GOP Sens. Charles E. Grassley (Iowa) and Orrin G. Hatch (Utah) personally appealed to Senate Majority Leader Harry M. Reid (D-Nev.) for a delay yesterday. Reid agreed and asked the Senate to put off consideration of the latest version of the bill to let bipartisan talks continue. This time, Senate Minority Whip Trent Lott (R-Miss.) objected to the move.
"That makes an interesting statement about the president's press conference this morning, that we just can't get those Democrats to do anything," said Sen. John D. Rockefeller IV (D-W.Va.), one of the SCHIP negotiators.

Hi,
The company I am working for is filing for GC.
They have posted an ad,and all the mandatory work is done.
HR up here have received some resumes for this ad.
After reviewing these resumes, attroney says they may have to place a new ad, as they have recieved a resume which qualifies the position from a local person.
I spoke to my manager and he says the same thing.He told me he did not even interview the local guy who applied.
Is this the only way out of this position. Please advise.
