Well his bills were mainly an attempt to stem H1b visa abuse. Maybe there is too much overkill, but look at his point of view. What would you do if you suddenly felt 10s of 1000s were misusing the H1b visa and entering the country. We also need to talk to them more and convey our position clearly, irrespective of party.

Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.
1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the �Other Worker� Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.
Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.
To be honest with all of you, I was really disappointed in the message from AILA. In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. How do you know that US masters degree dont need to work for consulting firms?
Do US masters degree holders work for Deloitte? IBM Global Services? Accenture? KPMG? Price Water House Coopers?
What about Oracle consulting services? What about TRW? Bearingpoint?
All these are consulting companies or the divisions of consulting companies. Both US degree holders and the non-US degree holding duffers like myself work in consulting firms(I dont anymore since 2003). In fact, I have had my classmates from India have to look for consulting jobs after they did MS in computer science from USA.
You are under the impression that the bill is outlawing desi consulting firms and firms that exploit.
The bill outlaws OUTPLACEMENT. And the bill applies to all firms, desi firms and the big 5 consulting firms and your IBM, TRW ... everyone.
Please read the bill and read the description in the first post.
And although I am the last one to engage in US-degree versus non-US degree and Masters Versus Non-Masters fueds, I am tempted to say that US masters or US degree isnt worth a bucket of warm spit when the market is bad.
When the market is really bad, like it was in 2001 and 2002, I have seen many Masters degree holders pack up and throw in the towel and I have seen many individuals with degrees from private Tier 3 university from India survive just fine in an environment where there were 80 resumes for each IT job. The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT.
However if you are proud of your US degree and US masters, suit yourself. But dont say things like "I dont need consulting". Coz you really do and so do thousands of others having US degrees.

The above statement is completely wrong. I needed assembly level programming and the binary math for designing satellite switched routers. There is no way to get packet processing time to less than a micro second without knowing assembly language and binary math. I have been in R&D for 3.5 years and I can assure all of you who are taking these courses that these courses are very relevant if you are looking for a job in high computing and high performance industry.
In addition I passed MS in 2001 and alongwith many others went through the same period of 2001 job market!

I will call the core team to see if they can add the age out situation to their agenda or help in anyway. There is another group American Families who are trying to get some benefit of dependent children of their spouses who age out and will try and speak with them also
If I win my cspa court case it will help many others. It does seem that the only way to get justice is to file a complaint , maybe a class action. It is so terrible that families are separated.
The aging out also applied to dependent children of people who marry USC too.
They say the CSPA is not retroactive, alos that alien must file for immigrant petition within one year of visa availability, yet it does seem all court cases have been won so far, well to my knowlege anyway
I have been separated from my son for many years and only option is court case. God knows how I will feel should I loose my case.

I got my Card Production ordered email yesterday at 9:00 PM and now at 7:20 AM I get mail saying I have been registered at permenent resident. So looks like the department that registers GC is slower than the guys who print the actual card. Has any one else seen this kind of reverse order of mails?

I am in the same situation.Posted May 7 to Arizona lock box. Received May 10 @ 11:12AM in Arizona. Check not encashed nor receipt notice received. I am going to wait for a week to 10 days before I call the Service center. Could be stacked up because of the New EAD format that is being issued.

Hi I am in process of filing 2nd PERM EB2 next month, my attroney says if the new position and job req is different then I should be fine(which is different than my previous Eb3 with 140 approved, Other Contries). But during my research I found some of the people are saying if 2nd PERM is file for Same employee , diff postion with same employer , it will hang at DOL for ever and I also found below posting only on Zhang & Associate:

About the PERM multiple filings, the DOL recently confirmed that if an employer has an APPROVED PERM application and files a second PERM for the same employee and a different occupation, the DOL will issue an audit requesting the return of the first application or an explanation of why there is a second application being filed and the first application can not be returned. The DOL is working on providing an FAQ which outlines acceptable situations where they will approve a subsequent PERM application.
The DOL also stated that if an employer has an APPROVED PERM application and files a second PERM for the same employee and the same occupation that the case will be auto denied. The DOL acknowledged that this poses a problem because there are valid reasons (e.g. change in worksite location) for filing a subsequent case and is working on this situation. I wont never want to be a US citizen anyways. GC is all required. are you kidding me. why would you want to be a citizen here anyways.

one, to vote, exercise a democratic principle, you can't complain about the government unless you actively participated.
two, I have 3 kids, and it's likely they'll stay here, my 12 year olds were 3 when we first arrived. My lawyer highly recommended we consider citizenship after another client had challenges. Despite good parenting this guy's kids got into trouble with the law, to the extent that they had their green cards revoked and they were in deportation process. However had they been US citizens whilst there were consequences they wouldn't have their citizenship revoked.

Not sure if I can attend the event but will definitely try to. Honestly every single person in the same boat should attend this. The event in 2007 changed the life of so many people and it is once in a lifetime thing. Let's make it happen again.
