It was EB2. The vast majority of the CA's we show equivalent to a US bachelor's degree. However in this case since it is officially recognized as a PGD a professor felt it was equivalent to a US masters and USCIS agreed. As a rule I would say CA=BA + 5 years work exp is a better way to go for EB2.

Thats true..everybody are bothered about EAD and FP. I am here for more than 8 years in this country. IV should emphasise this and USICS should allow affected candidates like us to file I-485 and atleast get EAD. we have priority date earlier compared to others.

We have received helpful data from the U.S. Citizenship and Immigration Service with regard to H-1B visa approvals in 2006 for the top 200 participating companies. Your company was one of the top companies on the list. Therefore, we are requesting your cooperation in providing additional statistics and information on your use of H-1B visa workers.
First, some groups, such as the Programmers Guild, have analyzed the wages paid to H-1B visa holders. They have found that the average annual salary of foreign workers is significantly lower than that of new U.S. graduates.
Second, a number of consulting firms reportedly recruit foreign workers and then outsource the individuals to other job sites or companies. Many of the top 20 companies that used H-1B visas in 2006 are firms, such as yours, that specialize in offshore outsourcing.
Third, a number of firms have allegedly laid off American workers while continuing to employ H-1B visa holders. The American people are concerned about such lay offs at a time when the demand for visa issuances and the recruitment of foreign workers appear to be increasing.

I dont see any light at the tunnel. PDs will not move until they allow 485 filing even PD is not current.
Please send the letter to WH if not already. As lasantha said, filing for I-485 when PD is not current is something IV is taking up with the administration. But, we need to get more letters to support our argument that this systemic dysfunction at USCIS is widespread and is affecting tens of thousands of people and not just a mere 1200 (that is the letters total so far and 10% of that comes from needhelp's efforts:))

State chapters are a great mechanism to communicate with other members in your state and district. Please use that if it works for you.
However, if you cannot find someone to go with you, then go alone. Many of the meetings we do in Washington, sometimes we get appointments from 2 or 3 offices at the same time. In that case we split up and only one person goes to meet the lawmakers or staffers. But we cannot lose opportunities or miss opportunities.
So go alone if there is no one else in your district to go with you.

those numbers.... 60% or 90% are all doctored...... and i'll look at the poll numbers only if both the following conditions are true -
1.) if i've no brain of my own to differentiate between right or wrong, so i must rely on the poll numbers to help me choose my position
2.) if i'm a cheap bastard running to get elected in some useless office ..... therefore i must do what is popular than what is right.... i must give up my conscience and i must choose my position looking at the poll numbers......
i'm afraid that neither of these two conditions apply on me..... so i'll have to disagree with u.....
so much for u'r slam dunk...... come back and read this after the decision by the US supreme court...... state of arizona does not have legal jurisdiction over federal immigration law. no matter how much evil we see around us... this world is made up of good men and women..... AZ will lose..... federal government is asking AZ to enforce the existing law and disband their illegal & illegitimate bill sb1070 becoz its in violation of the constitution of the country..... applying existing federal law will take supremacy over "AZ immigration law" ........

After I heard from the Infopass IO that my case is all set and it is sitting in the NSC examination room, I have been trying my best to get my file to the attention of an IO at NSC. This is what I have done till now. Don't know if this would work. If not, what the heck?
1. Wrote to my state's senators
2. Wrote to Ombudsman
3. Wrote to my Congressman
4. Wrote to the President
5. Have opened a SR
6. My attorney is taking an Infopass appointment to see why it is stuck.
We 2004 guys are really out of luck. First BEC, then all these LC substitutions, July 2nd fiasco, and now this. Can't believe we got screwed in all the steps.

On one hand we have VLD Rao crunching numbers like CRAY XMP and telling that EB2 will be close to current by End of the Year . On the other hand Mapadpa now says that the movement will be slow . I am a mere mortal and i am confused to the core on what to make of it ,

I would follow the advise of your immigration attorney on this one. Sometimes they ask for pay stubs, sometimes they do not. So I would follow what your attorney advises on you. Normally USCIS will not ask for W2's. However an embassy will, when you go for stamping. They will ask for W2 and your tax returns to verify if you got paid whatever is written on your application as your salary.

O.K. I know it's not the place for this discussion as we need to be optimistic and strong, instead of jumping the ship....
However, after years of wait (which perhaps was not that long compared to many others) and after sobber look at how much longer this may take I start to wonder if it worth it? I am starting to take what used to be a plan B - moving to Canada - more seriously now.

Maybe it has no legal validity. But still why to accept it. If they ask you to pay the fine/penalty, you will have to fight it before winning.
You can do one of these.
1. Ask them to remove the clause from the letter
2. Strike out the portion that mentions these and then sign it. Keep a copy of the signed document for yourself for future needs.
If this is just a "standard", they should not object to one of these. By the way such open ended terms are not common in offer letters. It definitely sounds fishy.
