This is really sad and very unethical. As my lawyer would put it, the I-140 is owned by the employer that's why he was hesitant at first to give me a copy. So I guess, your employer can do this. I think he knows that you won't have the gut to expose him since this will also put you in an awkward situation since you paid for your labor and I-140 which, strictly speaking, is against the immigration law.
Think of other ways to get even with him.

I still don't get it. There are around 300k AOS applications now pending. Given that there are only 10k EB based green cards for India, and I am sure there are more applications than 10k for FY2008 and still Visa bulletin for Oct indicates a date of Apr 2004. Should it not be "U" for the entire FY2008?

There are 2 agencies involved here - DOS and USCIS. Visa numbers and cut-off dates are owned by DOS. 485 applications are held and processed by USCIS as and when visa numbers are released by DOS.

I just wrote to the White House. I asked to Fix the LEGAL immigration system and I wrote why. It is so easy, just go here http://www.whitehouse.gov/contact/ and write to the U.S. president. If they receive 5000 of letters of same content, I am sure they will pass it on to the President.

Same thing happened with one of my friends. He went to India immediately got married and brought his wife to US, the GC status would not update at the port of entry system that quick so he took a chance. You can give a try to schedule an appointment at the Chennai embassy for dependent visa (through your H1B). My friend spoke with a reputed law firm (I dont want to mention the name here but you all know 'her') who advised this and he got lucky.
As the priority dates are current you can apply for 485 for your spouse. Good Luck!

I think there are people who have a labor pending from July 4th 1776 , so they might take the date back to July 4th 1776 when the US was formed and when the USCIS was established . However they will then not allow people living in the west coast and the then Confederate states to apply , only people living in the Union states will be eligible to apply .

- What did you do on the day you received it?
o Was glad but no celebration.
- How did the long wait upset your life?
o Yes for a while. But the entire episode changed my outlook and showed me a different perspective. After being frustrated for a while I realized I should not called myself �skilled� if I cannot navigate the rather simple green card mess. People are successful despite extraordinary physical handicaps and here I was restraining myself under the simple excuse of GC. I realized that I had to and could create oppurtunities for myself, without GC and without being in the US. Fortunately at that very time I got my EAD (June 2007). I gave myself a hard limit of 1 year and if GC did not materialize in a year I would ditch the effort and move to plan B. By april this year I began taking steps towards a change of job. My prospective job title was going were different but I was willing to risk the GC. Now I was wishing I should not get a GC since I would need to shelve plan B for 6 months. And suddenly on May 1st I got the GC, just when I did not want it!
- How did immigrationvoice help you during this long wait?
o Tremendously. When GC was important to me, it gave me a platform where I could act to make a change. I haven�t been active but just contributed a couple of hundred dollars to the cause.

The United States today indicated that it was willing to consider setting up of a joint technical working group to address the issues coming in the way of finalising a totalisation agreement with India.
New Delhi, on its part, has made it clear that it is not agreeable to the US stance of linking the requirement for a social security net as a precursor to finalising the agreement. India also made clear that it was adopting a calibrated approach to further opening up of the retail and financial services sector.
Indians working in the US have to mandatorily contribute to social security benefits but are unable to repatriate the same when they leave the US, in the absence of a totalisation agreement between the two countries.
The issue was discussed at a meeting of US Under Secretary for International Trade Franklin Lavin and Commerce Secretary G K Pillai in the capital. Commerce ministry officials said the Indian side pointed out that New Delhi had signed totalisation agreements with countries like Belgium and France, which had not set any pre-conditions.
“It was pointed out that India, which is a developing country, effectively gives a grant of $500 million to the US in the absence of a totalisation agreement. The US has indicated that it will soon have a video conferencing on the matter with senior Indian officials,” an official said.
In response to the US demand for further opening up of the financial services sector, the commerce ministry pointed out that India was adopting a calibrated approach on the matter.
“It was pointed out that the Reserve Bank of India has finalised a road map for the gradual opening up of the sector by 2008,” an official said, adding that New Delhi raised the issue of absence of a level-playing field for financial institutions in the US.
“A foreign bank wanting to open more branches in India only needs to obtain the permission of the Reserve bank of India. However, an Indian bank wanting to open up branches in the US has to go through the American federal system and then a state regulatory system,” an official said.
Banks like State Bank of India and ICICI have long pending applications for opening more branches in the US.
India also raised the issue of extending protection to its traditional knowledge under the patent regime in the US.

The solution is really to deport all the illegal immigrants and to tighten the borders.

If you do them legal (Young Illegals). simply, they will collect their Food stamps and their unemployment wages happily.

It is a beautiful country, no doubt. But opportunities, racial tolerance, good standard of living etc, all need to be considered while making such an important decision of one's life. Immigrating for reasons other than above is going to back-fire and a lot of lost-time and heart-breaks.
I have said this earlier and am saying it again - our home-country should rank much higher in our priorities than going to a country other than the US. I have been living in the US for a long time, worked in Canada for enough time to offer such advises.

Anyone invoking AC21 with unapproved I-140?
It is risky to change employers after 180 days before I140 is approved. If it comes to issues, when USCIS realizes one changed employment before I140 was approved, USCIS needs to verify that the underlying I140 was approvable at the time the change of employment occurred. By approvable it means that at that time there was no reason to issue a major type RFE for pending I140. If, for instance, the USCIS notices that at the time one invoked AC-21 and I140 was not yet approved and the I140 petition did not include (or included incomplete) educational documentation, it will say that the I140 was NOT approvable due to material evidence missing. And, at that time AC-21 can't work and may cause huge issues. One should be very wary of this and in general attorneys advise to wait until I 140 is approved before invoking I140.

I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.
