Wellwin I am totally agree with your points and whatever you have mentioned in your message is appreciable.
like_watching_paint_dry your points are valid but try to see from the other side I mean think if would have chosen for CP instead of 485.
Please don't hink that CP filers are not contributing in any efforts of immigration voice, I have also sent letters to president for this latest campaign although there was no point mentioned for CP. I know that we can win this battle together.
In short I just want to say that it would be good if we all work together please do consider the CP filers as part of this community.
Thanks
I do not get it.
As far as I know, a CP applicant can always switch over to AOS if already inside the US. It is harder for an AOS applicant to switch to CP.
You will have to make a choice. Do you want the benefits of CP or AOS? The way things are presently, you cannot have both. So pick one.

We as a community have not even done 5 % of the hard work that DREAM act advocates have done. So such provisions are well deserved by them for the hard work they have done. If we had done enough work for our provisions, there is no doubt our provisions would have seen the day. You need to do some search on all the DREAM act advocates have done in the last few years to reach where they are now. And then compare it our community effort and you will get the answers.
We recently had an advocacy day. How many of you contributed to it. We failed to even reach a modest budget goal for such a big event. So there is no point blaming undocumented. We need to first blame ourselves for doing nothing.
Only 200 ppl contributed and now 20 new memebers from July 2007 show up everyday in the prediction thread wanting to be current.
I believe there is a mini-advocacy in July - do we need to contribute for that. Any other details?

Bottom line, AC 21 comes with risk, and you have to be ready to ride the wave, if things are to get delayed or you are to be out of work for some time. If there was anything I could have done differently, I would have REALLY forced new employer to file H1b on my behalf. I feel i laid down too easily on this request after my previous company said they would not revoke I-140. I did ask the legal team of the new company, and they said no. I should have discussed with my bosses, since they really wanted me, and would have probably overriden the legal team.
But life goes on...
Good information for all those who had or thinking of using AC21.
Very well written to-the-point information.

Thanks. The most hilarity inducing section of this Q&A is this bit:
"Q2. Why is this policy being implemented?
A2. This policy change is in response to a 2005 DHS Inspector General recommendation that USCIS
align its background check screening policies with those of U.S. Immigration and Customs Enforcement."
That is SUCH a huge whopper. :D So they waited for 3 freaking years before implementing this!

Gurus,
Since EB2-India is current, I am exploring the possibility of interfiling.
Goal: Interfile in such a way that my new application under EB2 (New case
category) get attached with old case (EB3) priority date (07/2003) and
thus enable me to take advantage of EB2 current PD as declared in
April 2008 bulletin.
GC Application/s history:
-----------------------
OLD APPLICATION
Employer: xyz
Category: EB3-RIR Conversion-India
Priority Date: 07/2003
Labor approved
I-140 approved
I-140 approval date: 06/2007
AP and EAD approved
485 receipt date: 07/1*/2007
NEW APPLICATION
Employer: ZAB
Category: EB2-India
Priority Date: 06/2006
PERM LABOR approved
I-140 approved
I-140 approval date:08/2006
No AP/EAD/485 applied under this application
Notes: (1) Currently working for company CDE on EAD.
(2) "A" number on both I-140 are similar and different from "A" number
on 485 file.
(3) Occupation codes for both category are "Close" and matches the
job profile with current employment on EAD
Question: Is my goal achievable? If yes, then what to do and how to
proceed?
Thanks in advance for any help to sort this out.

Congrats,
The first part is cleared out for you.
I don't have enough experience to comment on the other issue.
All the best
Hi folks,
We had the appt wt infopass the other day.I guess it was just like others, some kinda error and that happened opening the SR wt TSC.They said our case is preadjudicated.and said we may want to check on the case by making an appt wt the center but maybe NOT calling and opening a service request. What a waste of time n energy, all the agony we had to go through!!
NOW guys i have some other issue/question to ask u all.
After the EAD is approved do u necessarily have to be working for the same employer who sponsored for you? Ours is like future appointment. The USCIS wanted some docs from us this June re the appontment/work related. And yesterday when we asked that officer she said our case is preadjuticated as of Oct 2009.So far we have taken couple of paychecks frm the sponsoring company. But then we have our own small business also that has kept us going. And we were thinking of taking more paychecks after the GC is approved.Does that make sense to you guys? or are we at fault?
PLS Suggest??

In response to my query to my attorney about the FP notices see her response below. And this is from an Attorney with 20+ years of immigration law experience. Anybody else in the same boat??:(
"I think we should wait. Yes, its been a while, but since is taking a long time for everyone, I think it just a backlog. Let's give it until after the first of the year. USCIS grinds nearly to a halt over the holidays.
Also, I got call from Senator XXX' office. For reasons I can't even imagine, your file, in its entirety, despite transfer notices to the contrary, is at Lincoln, where it was originally submitted by us as required. Your wife's file, also originally submitted to Lincoln with yours, was sent to California per the transfer notice, but was NOT returned to Lincoln, remaining in California. All this shifting may be a part of the cause of the delay.
After nearly 22 years in this field, and thinking I had pretty much seen it all, this is a new one."

This report is just released: Very interesting comments
The U.S. retains its global pre-eminence in science and technology, with a big boost from foreign students, scientists and engineers, a RandCorp. report said.
U.S. Still Leads the World in Science and Technology; Nation Benefits From Foreign Scientists, Engineers
Despite perceptions that the nation is losing its competitive edge, the United States remains the dominant leader in science and technology worldwide, according to a RAND Corporation study issued today.
The United States accounts for 40 percent of the total worlds spending on scientific research and development, employs 70 percent of the worlds Nobel Prize winners and is home to three-quarters of the worlds top 40 universities.
An inflow of foreign students in the sciences -- as well as scientists and engineers from overseas -- has helped the United States build and maintain its worldwide lead, even as many other nations increase their spending on research and development. Continuing this flow of foreign-born talent is critical to helping the United States maintain its lead, according to the study.
Much of the concern about the United States losing its edge as the worlds leader in science and technology appears to be unfounded, said Titus Galama, co-author of the report and a management scientist at RAND, a nonprofit research organization. But the United States cannot afford to be complacent. Effort is needed to make sure the nation maintains or even extends its standing.
U.S. investments in research and development have not lagged in recent years, but instead have grown at rates similar to what has occurred elsewhere in the world -- growing even faster than what has been seen in Europe and Japan. While China is investing heavily in research and development, it does not yet account for a large share of world innovation and scientific output, which continues to be dominated by the United States, Europe and Japan, according to RAND researchers.
However, other nations are rapidly educating their populations in science and technology. For instance, the European Union and China each are graduating more university-educated scientists and engineers every year than the United States.
Policymakers often receive advice from ad hoc sources. Although their viewpoints are valuable, they should be balanced by more complete and critical assessments of U.S. science and technology, said report co-author James Hosek, a RAND senior economist. The absence of a balanced assessment can feed a public misperception that U.S. science and technology is failing when in fact it remains strong, even preeminent.
There is a pressing need for ongoing, objective analyses of science and technology performance and the science and technology workforce. We need this information to ensure that decision makers have a rigorous understanding of the issues, Hosek said.
Among the studys recommendations:
Establish a permanent commitment to fund a chartered body that would periodically monitor and analyze U.S. science and technology performance and the condition of the nations science and engineering workforce.
Make it easier for foreigners who have graduated from U.S. universities with science and engineering degrees to stay indefinitely in the United States.
Make it easier for highly skilled labor to immigrate to the United States to ensure the benefits of expanded innovation are captured in the United States and to help the United States remain competitive in research and innovation.
Increase the United States capacity to learn from science centers in Europe, Japan, China, India and other countries.
Continue to improve K-12 education in general, and science and technology education in particular.
The inflow of foreign students, scientists and engineers has been a key factor that has enabled the U.S. science and engineering workforce to grow faster than the U.S. is graduating native-born scientists and engineers, according to the report. Researchers found that foreign-born scientists and engineers are paid the same as native born, suggesting their quality is on par.
But a recent reduction in the cap on skilled immigrant visas (H1-B) has the potential to reduce the inflow of foreign science and engineering workers, and the report argues that curtailing the supply of these scientists and engineers can lead U.S. firms to outsource more research and development to foreign countries and locate new facilities overseas. Rather than protecting jobs, this could lead to reduced investment and employment at home.
Among potential weaknesses faced by the United States are the persistent underperformance of older, native-born K-12 students in math and science and the heavy focus of federal research funding on the life sciences versus physical sciences. Another unknown is whether an increasing U.S. reliance on foreign-born workers in science and engineering makes the U.S. vulnerable. In recent years, about 70 percent of the foreign scientists and engineers who receive PhDs from U.S. universities choose to remain here, but the stay rate could fall as research conditions and salaries improve abroad.
The RAND report was sponsored by the Office of the Under Secretary of Defense for Personnel & Readiness and conducted within the Forces and Resources Policy Center of the RAND National Defense Research Institute, a federally funded research and development center sponsored by the Office of the Secretary of Defense, the Joint Staff, the Unified Combatant Commands, the Department of the Navy, the Marine Corps., the defense agencies and the defense Intelligence Community.

We will soon be launching a similar campaign in NorCal.

You guys are doing a great job of higlighting our plight. I have also donated 100$. You guys should probably start a seperate thread for fund raising.
Anyways coming back to creating awarness. I thought somone should create a podcast something like the ones we hear on NPR. The other might take longer and that is to send a documentry to Google current. It a tv station that just airs user created content.
Yes you guys are right not many people are aware of the issue. Up untill a week back I was under the impression (ignorantly blissfull) that the bill being passed in senate is going to reduce the cap.
I think the first step to be treated on par with agriculture workers is to be organized like them.
I have send out personal emails to all my friends and if anyone wants to reuse please feel free.

Hi Shana04,
Did you invoke AC21 with H1 transfer? I mean did you transfer your H1B to a different company which is not your GC sponsoring company? If so give me more details..
Question:
Am working for a GC sponsoring company and applied for 485 and received EAD, AP etc... Am not willing to move to EAD..can i change the company with a H1B transfer and invoking AC21? Pls give details..
Thanks
I have noticed soft LUD's on all receipts including I140, H1B with all other receipts (485, EAD and AP) for my self and my spouse after using AC21 with H1B transfer.
Not received FP yet and did not call Service center for it.
Any clues? or any experienced the same.

Rest assured we are working to remove the root cause of visa retrogression.
On a separate note, how can you start a thread demanding something from "IV" when you and few other people on this thread, stuck in backlog after 17th August, say that they don't want to volunteer for IV. Please explain why do you expect us to do all the work for you? If you aren't serious then please stop lamenting about your plight.
Join your state chapter and get involved, your active participation is what will strengthen IV and enable us to fix this issue.
I have sent a mail to the moderator of my region group to include my name and will particpate actively.

a self serving proposal..
MS is just a pretext for many who are here. MS is worthless if you are a software engineer.. you don't need MS to be coding in Java or .NET...
MS from some vague sidey backstreet community college cannot be compared to MS from other better off schools.
your proposal is distracting from the main agenda. CIR or other relief measures.
Agreed, but still there is a quota in place for STEM graduates in H1-B regardless of the university rating/quality. The law makers/USCIS approved it - so there must be something in it that appeals to them. In my opinion, it would be much easier to work on extending this benefit to GC process as well (its mutually acceptable for both the establishment and applicants since we already have a precedent in the H1-B system). Hypothetically speaking if an additional quota of 20K is created for STEM graduates, it will help every one involved. Not the perfect solution, but probably one of the most practical and likely to be approved one.
People with STEM degrees will probably get their GCs done faster which to some may appear unfair. But under the cuurent circumstances, what other options do we have?!?Status quo which means, every one is stuck or a separate quota so that at least the queue keeps moving?

Don't worry. Most likely, it is USCIS error. Check why after 140 approval, they sent to DOS while you are in Adjust of Status? May be USCIS entered wrong in system and creating issue.
I would take INFOPASS and contact local Congressman.
Good luck !!!

I think I can wait until this month end to start expediting process. I will have 17 days window.
What do you suggest guys? Is that a reasonable time or I should start right away?
Thanks

Thanks so much man! Actually I was all set for Sept 13 but have a work appointment on Sept 18, yet I am even thinking of cancelling that to attend. I don't care how expensive it is. This is historic, just like Martin Luther King's Civil Rights movement! We can make history! It's an investment in our future!

It seems you contributed to the common IV fund since you didn't hear from us in time on that thread. Sorry to hear that!
If you are willing to help with even $50 more, it is more than welcome at this time, as there are people waiting for 50% airfare sponsorships and there aren't enough sponsors.
Please consider.
Anyways, thanks for all your support for the rally!

Eb3Retro,
Did you drive car on High Way over the speed limit and got ticket.
And passer by drivers at Higher Speed than you. Can you point police for stopping you.
So don't tell that you are fine and everybody is fine.
What if someone here saw your postings (800+ posting guru) and travels wihtout Transit Visa and Aitport people ask for Transit Visa and missed flight--- Have to stay at Airport for hours.
Try to accept rules guys....
easyvishwak, there is a common disclaimer in any of the internet forums that you take the information with a pinch of salt. people post their experiences, whether to follow or not is totally your call. Next time, I wont be so polite when writing my response because you mentioned some unnecessary things in your response to my post. So, please do not aggrevate me. that was my experience, whether you want to take it or not, or, if others want to take it or not is totally upto them. same way, u dont speak for others. keep it to the point and dont do any personal attacks.

Hello All-
I am going to India via Franfurt next week.
I have AP with visa expired.
I saw the following document on German Consulate - New Delhi. http://www.new-delhi.diplo.de/contentblob/1827030/Daten/857105/DD_Airport_Transit_A.pdf
It says:
- a valid residence permit or visa for the USA, Japan, and Canada
- An Airport Transit Visa is not required for holders of valid visa issued by
Bulgaria, Romania, Cyprus, Ireland, United Kingdom, Canada, Japan or
the USA irrespective of the travel destination.
I have a Canadian Visitor Visa. Do you think I will need Airport Transit Visa or I am reading it wrong?
Thanks for any help!
