Sorry to hear about your situation but there is a small glimmer of hope. As per the deadline set for clearing labor backlogs, DOL has targeted it for September 2007. And as per the bulletin today, the visa numbers are expected to be current until at least October of this year. So let's hope your labor gets cleared by then and you can then concurrently file for I-140 and I-485.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

I like the food from a particular restaurant.
- I go there often, enjoy the food, and recommend it to my friends.

- I don't go there at all, even when I am hungry and I will tell my bad food experience to my friends - either convince them not to go there or let them decide on their choice.
Reasonable? Logical? Practical?
I like what IV has done, what IV is doing currently.

Now, I don't like a particular restaurant, they serve bad food, bad customer service, waste of money, time - BUT I still go to the restaurant, eat the bad food, complain of the customer service, spend money knowing very well I am not getting its worth, and then stand up in the middle of this same restaurant floor and tell people this restaurant is not good (while eating) and tell my friends not to go to this restaurant (while I continue to go).
Reasonable? Logical? Practical? Or Unreasonable? Illogical? Impractical? - I would say second choice.

Nice analogy but note that IV for me is like samplers. If I like what is being offered, I would donate. If I want some thing to be given as sampler, I will buy, contribute and market it. I cannot donate for samplers which were given before I knew abt it, even though some good people got benefited.

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

Lets not get sidetracked by Mr Skillz with a Z.
Options for EB3I relief:
Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.
PLEASE be brief - bullet points would be good.
Also links to articles to support your concerns are welcome. I will put together a package to hand out at the meeting.
I thought of posting a poll on this thread, but decided it would be better to leave the discussion open ended.

- Documents like labor and I140 are never shared with the employee.
- The unfortunate in the slowest category gets a shot at US citizenship far later (10-15 yrs) than their more lucky counterparts.
- Changing employment is very risky and an employee remains bound to serve the same employer for many years, or have the process reset.

You envy the ones who got the GC and pity the once who got shipped.

I asked them to provide a copy of their US insurance policy and on-site employee handbook. I am yet to get one, besides the manager told me since I am no way connected to Losers and Traiters (who wants to?), I am not allowed to ask for such documents. The poor slave friend of mine went to India and resigned within a week.
