Guys, Can we get some corporate funding on IV's effort. I agree that our contributions can also make a difference but if any big corporate decides to support our cause, don't you think it would make a very big difference, funding wise. Big companies like Mircrosoft, Oracle also do favor immigration reforms and I think they too are currently lobbying for the same. If somehow, we can also extract some contributions from them for the same cause that would really give great impetus to IV's efforts.

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,
For 2nd Case should we file by mail, providing certain reason with the application?
I personally know someone who got BPC labor approved in Eb3, then applied for Eb2 for same position , only difference was his first company was bought by another company and he applied Perm with 2nd company.

I assume you all checked ur GC wait time - which probably gave u like 10yrs or 18 years from today. Are you expecting vertical spillover to put you on fast track lane?? say getting a GC in 2010? 2011?? 2012???
vertical spillover will only help EB3's that are very close to Visa Bulletin dates.
There are app 200k people waiting, changing how they allocate leftovers is not going to help 200k hungry people. What we need is more food (more Visa's).
I am awe'd by the shortsightedness of the solution being discussed in this thread. Do you really think vertical spillover is going to help an EB3 > jan 2006???
when we are ready to spend "X" $ on getting a law change for "vertical" spillover, why not spend "x+y" $ and put same effort and get a permanent solution - "Visa recapture" ???
Moreover the latter is certainly going to get you a bigger participation from EB community. Visa recapture will benefit the entire EB group and future applicants too.
I strongly urge you folks to think about these.

It is simple human behaviour - we are all here to safeguard our own interests. Not still sure if the forum is going to side with EB3 or remain neutral. Surely they can support EB3 - they have the liberty to do so and it is perfectly right. In that case, EB2 should create their own platform to defend their interests... May be EB2 guys should think about it...In my opinion, everyone has the right in a democracy to work legally towards their goal / ambition . This is absolutely jutsified. It is not a sin. All that I am trying to say is that EB2 folks should be proactive and act before it is too late.
If EB3 were to race ahead of EB2 tomorrow, will they support EB2 or work for equitable distribution? How many amongst EB3 have used the Labor substitution to their advantage? Will they back out now? Let them touch their heart and answer this, instead of giving red dots :)

If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

To pursue this issue as a separate issue is not inline with IV's policy.
If aids receive lots of lobbying all on separate issues there will be no progress on any issues.
There is a recent thread on I-140 delays, clearly the author thinks that's one of the most important issues.
There is a thread (this one) on age out.
There are probably threads on all sorts of separate issues, I'll suggest a few:
People still with labor pending, applications that BEC completed may still be pending advertisements etc.
People with I485 returned in error.
Consultants worried about H1B renewals.
My point was that age out can be raised in meetings that address the big picture. Once we get a seat at the table there is more chance to get all the issues addressed.
An alternative strategy is to try to find law makers in favor of niche issues, like FBI name check (already being addressed), age out, I140 delays. The trouble then is that we might get some niche issues addressed but not the big picture.
If you attend law maker meetings as an IV member talking about the big picture you then have the opportunity to raise a personal example (this can be powerful). It would help you and help IV. A huge number of us have powerful cases, some economic, some family orientated.
Basically I'm saying that the sum of the whole is greater than the sum of the parts.
It appears that you wish to lobby separately, or at least not following IV's strategy. CORRECT ME IF I'M WRONG. I only gained some limited knowledge of which law makers and their aids may be more sympathetic to family type issues (e.g. age out), by being part of IV. Thus I do not feel free to give out this information for lobbying use that is not part of the IV work.

If you need something it is best to email me. Currently I'm working maybe 6 to 12 hours a week on IV stuff and that leaves me little time to read forums.

My experience says it doesn't matter too much. Just attach a letter explaining that and send the fees. If you are in rush pay the highest fees or else send the lowest fees. If there is anything missing they will send the application back (at their own cost) and ask you to provide more info/fees.

My understanding is that local office would not open a service request. But they could request interim EAD. Since they no longer produce it locally they have to request some service center to issue one.

Wow, I am in exactly same boat, So , basically FP results are blocking EAD card production!!... next renewal, It will paper based EAD.!!

Per the guy at the InfoPass counter, the FP report was received on July 24th (which probably explains the July 25th LUD). He said EAD will not be printed or sent out before FP check is complete. In 2007, they did not run FP checks to issue the first EAD after July fiasco.
So could this explain the delay that folks here are seeing? FP Code 2 was done for EAD, so not sure why this should take so long :mad: Maybe I am mistaken, but I thought that only FP Code 3 that's done for I-485 can take a long, long time. Can someone post info on EAD FP checks?

that the years for Citzenship count the day you apply for I-485...not actually recieving the GC..that was his lawyers opinion..
