    Hi ,
    My I140 approved with priority date in November 2007. My wife works for American Vendor and her 6th year on H1B would be over by October 2012. Her company is not willing to initiate GC process. Right now her job is going smooth and could go for little longer. I wanted her to continue till mid of next year and then look for H1B transfer with immidiate GC process. Now the question, Is there any rule that we should start PERM 365 days before end of 6th year? Because I heard that we should file Labor in 5th year (365 days before). I am kind of confused... Please clarify this , I really appreciate it.

    Are these docs sufficient for EAD paper renewal?

    -I765 completed form
    -2 photos
    -copies of previous EAD's (front and back)
    -I485 receipt copy

    Anything to be written in pencil on the back of photos?

    I'm ready to file AOS, while filling in the forms I realized that I have just one more page left in my passport which is valid for another 7 years.

    - If I get a "new booklet" from the Indian Consulate, does it come with the same or different passport number?

    - If it has a different passport number, does it affect the AOS application once the AOS has been filed with the previous passport details?

    I don't think different passport number will effect the AOS application.

    Hello everyone,

    My H1B Visa Stamp expires on Feb 28, 2008 but I-94 has a date upto Mar 10,2008. Is it safe to travel to India and return on Feb 22, 2008 (Just 1 week before the visa stamp expiry)?
    Please let me know.

    Last year, I was in the same situation and per my employer & attorney's advise I was told that it's not a problem and I can even return even one before my visa expires....I returned to US just 3 day's before my stamped visa expires and had no issues at all, FYI -- I had my 7th year approved notice too and my 1-94 was given based of approved H1 notice. My POE was Newark,NJ

    I called 4 member, the person at frontdesk didn't transfer me anywhere. Also, they knew why I am calling and they remember all three Bill Numbers by heart now.

    When I said Can I leave the message then I was told we got your message Sir, and I will pass on the message to Senator.

    The frontdesk staff is instructed not to transfer our calls to the right person in their office. So after calling 4 members, I stopped.

    Well, if there were preadjudicated cases, which is very very likely, getting ready for September approvals, with VB published weeks ago, should be very routine and simple task. It is quite possible that a lot of approvals should be coming out withint the first few days in September. Best wishes to all waiting, particularly to those wth senior PD's left out last year.

    GC is moving target, looks like some drunkard wakes up one fine morning and randomly moves the priority date value/importance. I know those in such situation may be relatively less in number but I know many who are and repurcussions for this look horrible for people who have not made past this luck test. I was one of the unlucky ones :(. good luck to guys who have moved forward hope you still help rest of us still stuck.

    I don't think it's an end of fight for IV or for that matter for us. Ability to file for I485 is just like getting out from one queue and standing in another big one. Once the folks who are stuck in backlog gets their labor will be in front of this big line as you know the priority date counts. Only advantage for the people filing 485 is an EAD, which I know is a big one. With thousands of people filing I485 in July, I believe EAD itself is going to be retrogressed.

    So, we should continue to fight for increasing the Visa number and removing the country quota or similar provisions. Now, we might need to re-state our goals as asking to remove retrogression cannot be the one. I know IV core might be thinking in the same line but currently just busy collecting their 485 documents ;) . So hold tight and we should see some plan once this excitement dies down.

    FYI, i'm one of those who will be filing 485 in July but really apprehensive about getting EAD in next few months.

    So, lets get united and re-organize our priorities and fight for the same cause.

    The Senate passed today Fair Minimum Wage Act, H.R. 2 today. The House passed this bill, H.R. 2 and the Senate debated the bill for the past several days. In the process, hundreds of amendments had been introduced on the Senate floor. The Senate floor then agreed to a lot of these amendments. One of these amendments which the Senate had agreed to and passed as Division B of the H.R. 2 is the Immigration Reform bill.
    The immigration reform bill was introduced by Senator John Kerry and agreed to by the floor unanimously. The immigration reform bill that the Senate passed today covers a lot of the provisions which were part of the Comprehensive Immigration Reform Act of 2006 which the Senate passed last year and failed in the House.
    We will analyze the bill and report it step by step for the next several days. Please stay tuned to this website.

    Wrong....Cubans don't get GC based on EB. They get political asylum because their country is in shambles because of Communism. Is your country in that state too? Everyone's time on GC counts towards Citizenship - that is the whole idea of 5 years wait. By the way the wait is not there for a random reason. The wait is there for you to decide if you really want to become a Citizen. There are millions who just stay on GC for 60-70 years of their lives. It's a choice given. And like someone said - there are more pressing problem for us now than Citizenship. All it gives you is a right to vote and a duty to pay visa fees to visit your home country. :o

    This is a good idea. Cubans get the GC the day they land on this country. They can also count the number of years they waited on GC towards citizenship. All we need is a good EB-immigrant community lobby and few senators/reps who would do our bidding.

    GCPerm, Saralayar, spicy_guy, freedom_fighter and others ........ dedicate your time (30 or 60 minutes everyday) on green card backlog issues. Help us all in this process.
    Things are not as easy as it seems......Writing letters alone does not solve problems - and reading pappu's post - monthly trips to DC, meeting with (dont know who all), raising funds, having lobbyists -- all of these are things that take up time. IV has already said that it cannot take it on unless they achieve the primary goal of clearing backlogs.

    Think about it, gcperm is the only guy who has met with Schumer's office. That's it. Even he has no idea on how many more senate offices he has to meet....... Or how deals are cut to get any legislation considered............. I read the Citizenship doc - nothing in it is viable - everything in it only shows the total lack of knowledge regarding laws.
    US in never going to adopt point based system - for green card or citizenship. Every other recommendation past 4 relates to point based system - so chuck them out. As for recommending the form and the fee for it - and actually putting the price on it - again shows the lack of thought.
    The third and most important one, you are asking for these benefits for employment based category - things never work that way. Every group of immigrants will ask the same benefits or if they cannot get it, they will fight tooth and nail so that no nobody else gets it too.

    Congratulations for getting your green cards. Stay and help out the members who are yet to get their green cards. IV am sure would take on the issue of citizenship once it has achieved its primary goal.....

    I agree. No point system. But how is asking for wait time after filing 485, counted against citizenship eligibility, not valid? Its perfectly valid and that eases the pain for MANY!

    Hi!

    My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).

    I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:

    1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?

    2) I noticed that the fee is:
    - 190 for application
    - 500 for fraud security
    - 750 or 1500 depending on whether there are 25 or more employees
    - $1000 premium processsing
    - $$$ for the lawyer to prepare and file the petition

    Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.

    3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?

    4) Can the entire process by done online?

    I will really appreciate it someone could help with answers to these questions.

    A lot of Desi Consulting Companies do these kinds of things. They can cook up any resume and any requirement.

    Real PHD guys who worked their asses off day and night in trying to publish some worth while papers are not getting consideration for EB1 and these DCC guys with a bachelors in any discipline and 5-7yrs experience can become Multi-national executives and fall under EB1.

    Nothing helps us legally working people with US Masters Degrees who have been living as law abiding citizens for years.

    One of my friends who did Bachelors with me in India came to US on h1B and actually bought his EB2 Labor back in 2005 through a DCC and now has a GC. He never even told me that he did that. He told me recently after he got his GC.
    I agree that is really a b*** . We pay taxes, contribute to the economy/society etc and we don't preference wheras any manager living outside can get GC in 6 months is very dissapointing. I don't blame the ppl who got through DCC like this but the law itself should be fixed.

    Value of a "person" will be known when he is gone. But the worthlessness of material thing gets realized when it actually comes. Character of a person is truly tested during trying times. May you reminisce about it later and wonder why didn't you do better

    I think your calculation is wrong. If there are 8742 applications then it should take less than 3 years not 5 years. In the 2nd case for 14583 applications the wait would be around 5 years instead of 10-12 years. This is due to the fact that every year around 3000 visas go to EB3 category. Though this is a long wait too so either way we need legislative fix for all the cases.

    Have dependants been counted as part of the 8742 applicants - or are they just primary applicants?
