    Here is the reality: The thread is 2 years old and we have not had a group of motivated folks who could commit both time and money for this. In the last 2 years thousands have read this thread and have got greencard, but after getting greencard most people have different priorities in life. Writing posts on the forum asking IV to work on it will not get anything done on this issue. Nobody else will do anything unless those who seriously want to work on it commit their time and money for it.

    They need to be going to fund raisers of lawmakers and contributing to election campaigns etc as a first step to lobbying. We need to see IV green card and citizen members doing this more regularly anyways to help others in line behind them and get more politically active.

    Here is how people can organize this effort:

    If some green card holders seriously want to work on this issue, the first thing they need to do is form a team. Commit for a long term effort. This is not going to be an effort for a few month or days but will take several years. After you form a team, the next task would be gather as many people as you can who want to work on this issue and wish to meet lawmakers. You will also need start-up money to work on this effort. This effort is not as simple as fixing green card backlogs. If we are thinking working on this effort will be as simple as writing emails, then it will not be worth spending time. Be prepared to personally go and meet lawmakers in both your area and DC every couple of months. IV core team has been making trips to DC every month for past 4 years and only then we have been able to bring our issue in focus.

    Citizenship rule change would change the INA and would require lot of support from H1B community, Greencard holders and citizens. It would require lot of funds too. Be ready to contribute your own funds (not hundreds but more than that to start) to run advocacy tasks. IV site is just a platform with a web-forum, but the real work that costs money is daily advocacy operations. Running is site is not expensive. Once the effort gains momentum, you can raise from IV forums from other Greencard members as a separate pool just like we did for FOIA.

    At this time IV does not have the bandwidth or resources to work on this issue. Our primary focus is fixing greencard backlogs so that our members are out of the Greencard Queue. We started this organization for this purpose and we wish to finish what we started before we take on any new effort. Even though some core team members have Greencards, we are all committed to work on Greencard backlogs and will not work on other agenda items in our limited time. It will have to be a parallel team within IV that can work on this issue. IV team can guide as needed but we simply cannot divide our limited time and resources on a new effort.

    I fully second Pappu's comment as the current IV core leadership does not have time/$$ to spend on Citizenhip. Getting GC for all of us has and should be the first priority. Thanks to IV core and many of us fellow volunteers, their effort has paid off as things are moving decently fast for EB2 for now. Hopefully our fellow EB3 friends also see some hope in FY'11. As I was saying in the previous posts, many big corps have not filed for new labors in FY'08, FY'09 which should free up many ROW visas. This should help EB3 in the near future.

    Second question is, In my old passport there are 2 valid US visas, 10 Yr B1 and 3 yr H1. How do I get them on to new passport?

    You don't have to ( you cannot) transfer visas to the new passport. You will have to carry both old and new passport together all the time. POE officers/Indian immigration officers will use the old passport to get all your visa and travel information.

    a lot of companies are already getting their patent filing work done by attorneys and paralegals abroad. Wont be too long before your I-485 filing is also prepared from outside the US :)

    True. They are already preparing tax returns from India. I've heard of some tax preparers (competition to H&R Block) who have a VoIP phone and prepare tax returns by interviewing the tax filer. And they are lot more effective in getting a return. A small correction to AmericanDesi's observation that EB1 is for Ph.d . You don't need a formal Ph.d for EB-1. If you have demonstrable extraordinary ability which will benefit the US government and people, you come under that category. This usually requires 40+ peer reviewed publications in International Journals in your area. It isn't that easy buddy getting in under EB1 if you think that all you have to do is to be in school for 5 years and submit a thesis at the end of it. And it is getting tougher and tougher to get in under EB1 as they are scrutinized more.

    Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!

    After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....

    After 15 years in the US, I will finally have my green card in hand soon.

    If a senator introduces a immigration bill, Its put off until CIR. All immigration related bills should be together.
    But, when CIR comes to discussion, everyone knows it would never get passed. Too much opposition.

    You should ONLY use AP to re-enter. Do not re-enter on H1. In the secondary inspection, the IO will know that your GC has been approved. Congratulations !!!

    On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
    We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
    Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

    Wow, I am in exactly same boat, So , basically FP results are blocking EAD card production!!... next renewal, It will paper based EAD.!!

    EAD e-filed: May 27th
    Receipt notices received: 1st week of June
    FP done: June 19th
    Card production ordered LUD: June 28th
    Other soft LUDs: July 25th, July 27th
    Still waiting...

    InfoPass: This morning...07/28/08
    Per the guy at the InfoPass counter, the FP report was received on July 24th (which probably explains the July 25th LUD). He said EAD will not be printed or sent out before FP check is complete. In 2007, they did not run FP checks to issue the first EAD after July fiasco.

    So could this explain the delay that folks here are seeing? FP Code 2 was done for EAD, so not sure why this should take so long :mad: Maybe I am mistaken, but I thought that only FP Code 3 that's done for I-485 can take a long, long time. Can someone post info on EAD FP checks?

    Update: Here's what I have after some quick research on USCIS biometrics:

    New Direct Filing Instructions for Certain USCIS Forms

    Petitioners and applicants are advised that new Direct Filing requirements come into effect July 30, 2007. USCIS says it will not reject cases filed in the prior filing location for 30 days after the new instructions go in to effect, that is, through August 29, 2007. This is true as long as the forms are accompanied by the proper filing fees and otherwise meet the filing requirements.

    Note that on and after August 29, 2007, USCIS will reject cases filed in the wrong locations.

    Direct filing will be implemented for the following forms: I-129F (Petition for Alien Fianc�(e)); Form I-131 (Application for Travel Document); I-140 (Immigrant Petition for Alien Worker); I-360 (Petition for Amerasian, Widow(er), or Special Immigrant); I-485 (Application to Register Permanent Residence or Adjust Status); I-765, Application for Employment Authorization); I-907 (Request for Premium Processing).

    USCIS says it will issue revised filing instructions shortly. Meanwhile, in order to help the public determine the proper direct filing location, USCIS has developed a series of filing charts and posted them on its web site at www.uscis.org at the forms information page.

    The above affected forms filed with the new direct filing locations prior to July 30, 2007 will NOT be rejected.

    4) whatever IV does, hurts EB3 more. I don't think any admin fix will fix the vertical spill or recapture.

    I agree with you. IV efforts knowingly or unknowingly swept all the help towards EB2. IV might not have done this willingly, but this is what happened.

    Congrats to all those who have received their approvals. Do you get a "Card Production Ordered" email or "Welcome" email or both?

    My attorney got an e-mail, i haven't gotten an e-mail yet. But i checked my online case status, which says card production ordered, should have card in 30 days time. My atty said that they are having some trouble right now with card production, so maybe that is why it says 30 days instead of 10 business days as it did in the past.

    Meeting is better than emailing, as emails do not get read. Ask IV Coordinator for the presentation zip when you get an appointment with your lawmaker.

    Friends,
    I know once I 485 is filed and I 140 is approved after 6 months you can move to a simlar job.
    My question is what you get laid off after 6 months of filing I 485 but you cant get a new job immediately, what if you get new job only after 2-3 months gap - what are the reprecussions ?
    Also is there concrete guildlines on what same or similar job is ?

    This request is regarding workers on H-1B:
    Problem: H-1B status ends the moment a foreigner worker looses his/her job, and s/he is effectively out of status. The foreign worker has only 10 days to wrap up his/her affairs and leave the US. 10 days is just not enough time to wrap up five or six years of living and move.

    Solution: The foreign worker's status must automatically be extended by 90 days in the event of job loss.This gives the worker enough time to get his/her affairs in order -finances, car, house/apt, kids in school, etc.

    I had called them last week and was told the ususal spiel about my processing time not being current. But the lady also slipped with some piece of info that I did not have before: The processing dates are updated every 2 weeks....we do not see that online. While I am not sure that is true, I still figured hey let's call again and see. So yesterday the guy on the phone told me that I am outside their processing times and that he will put in a service request to make sure they will take care of my application....and my RD is July 2nd.....so their might be some truth about them internally updating processing times.....maybe
