Great idea on focusing on the longer term and going for citizenship. Starting the 5-year clock at the time of 485 filing sounds like the practical way to do this.

Great effort Saralayar. I just voted. Vote for this, everyone. This is the least we can do get on the radar. There are so many voices crying for attention --- please vote so that we may be heard.
It is very easy:
1. Go to http://citizensbriefingbook.change.gov/home
2. Register, by clicking on "sign in to get started now" (very quick --- no email verification steps, etc.)
3. Search for "Citizenship if you have lived legally in this Country for 10 years continuously" (without quotes), in the "find an issue you care about" search box
4. Vote by clicking on the up arrow.
Post a quick comment as well. This way we will draw more attention to it.
Could not find the link..Which page do I need to go on to vote.. I have searched about 500 pages.. Pls. advise..

After staying legally for so long, and suffering due to administrative lapses, I think we must ask for Citizenship. Nothing wrong absolutely. Just compare yourself with your friend who is applying for Citizenship, though you are equally eligible. Dont ask for less. NOthing against who got in.
When you have fulfilled the requirements, then you must get what you deserve.
When we post our requests and stories on sites incl obama'ssite, do make sure you mention about Citizenship also. Its not easy to settle back home with some situations like children etc..

You've already made one short term decision- home prices are rising let me cash in!! Note, I said home prices and not home values.
Dont make another short term decision- everyone is walking away, let me do the same. No more debt- wow!!
As others have said on this forum, there is no reason to exclude yourself from the legions of "fools" who caused the mortgage crisis.

well this is great news there were no hits for my husbands name and only 1 hit for my name! Hopefully we will be ok and not get stuck in name checks then! Thank you for your response!
How did you know the Name check status ? Did you call USCIS ?
It is interesting to know they start the name check before FP.

I believe they already answered the question: they claimed the previous allocation scheme was wrong and the current is correct. There is nothing more you can possibly get by questioning on this issue. Even if there is anything behind the curtain, that explanation covers everything perfectly and there is nothing you can do about it.
We can definitely question them on how their understanding changed on visa spill over distribution.

you are partially correct about this statement worldwide level = 140000 & EB3 = 28.6% of
but there is another rules that screws us
per country limit is 7% of the total, hence
140,000 * 0.07 = 9800 per country limit
9800/3 = 3266.66 per category if we assume that there are 3 categories. If we include EB4 & 5 the number is less than 3k per country. I think that this number is more accurate because most of the other blogs mention the fact that EB3 1 will get maximum of 3k per year if there is no spillover. My PD will be current if they set 5.5k per country for EB3 I, having been stuck in every step of this !@#!@ process i feel that the number will be around 2.8 (consular processing etc).
I am not considering any spill over etc...
here is what says on visa bulletin
Visa Bulletin October 2009 (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html)
The worldwide level for annual employment-based preference immigrants is at least 140,000.
EMPLOYMENT-BASED PREFERENCES
First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.
Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.
Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second
preferences, not more than 10,000 of which to "Other Workers".
worldwide level = 140000
EB3 = 28.6% of 140000
can you please clarify ?

"Letter Template #1":
Date:
The Honorable George W. Bush
President of the United States
The White House
1600 Pennsylvania Avenue NW
Washington, DC 20500
Dear Mr. President:
I write today to urge you to fix America’s broken legal employment-based immigration system. Currently, more than 500,000 skilled individuals who contribute to the American economy through their hard work in high technology, scientific research, medicine and other fields find themselves trapped in a process that is hopelessly backlogged. If nothing is done, hundreds of thousands of immigrants will wait years or even decades in a process that was never intended to take so long. While comprehensive change will require legislative action, your administration can implement administrative remedies to improve America’s competitiveness, eliminate bureaucratic inefficiencies, and improve the quality of life for these legal, highly-skilled immigrants.
Attracting and retaining the best and brightest minds from around the world is in America’s best interest. In February 2006, your Domestic Policy Council issued a report on the American Competitiveness Initiative that recognized the importance of employment-based immigration. The report stated:
“The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals.”
You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken.
Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department’s mission.
The greatest impact of the broken green card process is borne by the legal immigrants and their families. The more than half million highly-skilled legal immigrants already working productively in the United States find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs – even within the same employer – without starting the arduous immigration process over again, and subject to waits that grow longer and longer.
We implore you to exercise your authority to implement administratively these much-needed reforms.
• Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
• Revise the administrative definition of “same or similar” to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
• Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
• Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
• Allow visa revalidation in the United States.
• Reinstate premium processing of Immigrant Petitions.
I urge you to implement these administrative remedies without delay. Action is urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.
Thank you for your attention to this matter.
Respectfully,

gc26...., It seems that you have missed the point again. Any logical person will have the capability to comprehend that this thread is against visa abuse in L1 category.. If you still didn't get it, objective is to explore the options to report abuse of L1. Benefits are: genuine people still get the opportunity, reduce over supply in market, not bring wages down etc.
Its that simple. If you can give me 1 good reason to not bring this issue up, I can definitely discuss the issue. But, stop giving me this crap about raising voice and being right...
Totally, non baseless argument by you and Ganguteli...

This is good news indeed !
12,000 extra visas available to EB2 at the end of second Fisc qtr would be excellent !!
Worst case I think they'll have to match EB2 India with the EB2 China date before they take it even further in the coming months for the both the countries.

But i recieved a letter to wait for 6 months...:(
Any suggestions????
I didn't get an email but got an sms from USCIS about the case status change to Decision. Here's the update :)
Decision
On October 13, 2009, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
Does that mean an 'Approval'. Between we moved to AZ from FL this week and I'm sending my AR-11 and changed the address over the phone. Is there anything else I need to do ?

When I call through vonage phone, the wireless internet connection to other computers is getting lost. Is this the problem others have too?
Is it having another router in between your vonage phone and cable /DSL connection solve the problem?
Any thoughts? Has anyone inquired this with vonage folks?

This is an excellent point. DOS publications claim that PIMS has all the information since 2004. Please mention your approval dates too. There could be a delay pattern pertaining to the approval date.
Anyone with H1B after 2004 has seen any delay???
This forum has provided an incredible amount of information for ignorants like me. Please keep on updating this thread with your experiences and details. Mention your approval dates also.
Thanks
H1b approval notices are for 3 yrs. So most folks who are going for stamping now will have approval dates much after Jan 2005. So DOS claiming that all cases after 2004 is not correct.

FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.
I agree with you. I was once-upon-a-time a vonage customer, then I got reformed. :D
When you are a customer CS will treat you like God. Once you call them to cancel, they will play all kinds of tricks. They even lied to me about certain things.
But this 24.99 unlimited India offer sounds really good. I might consider signing up again.
