I was pleasantly surprised, although looking back at it, this was going to happen. The Indian media would have immediately tried to cash in on the news and interview the people associated with the movie.
Nevertheless, this is good news, and I wonder if we should try to capitalize on it. How?
If IV can get "IV merchandise" (T shirts, caps, etc) signed by a Boman Irani or a Rajkumar Hirani (and perhaps also embossed with a standard message that we all included with the flowers), and put it up for sale (on ebay etc), it might help to
1. spread the word on this issue
2. raise money for IV!
What do you think? Is this feasible? If it is, we should go for it as nothing matches Bollywood when it comes to spreading a message.

I personally know many who had been "working in H1B" for more than 14 years.
Not everybody gives more weightage for their "immigration plan" than some personal and career interests. If you are really truthful to USCIS about your intentions, and you keep doing what you want to do with your career and life, it is in-fact very possible that you will be found without a GC even after 10 years working in USA, if your are from India.
An approved I-140 doesnt make you "automatically" qualified for an I-485. You dont file 485, if you dont "intent" to continue with that specific employment, even after I-140 approval.
7Years???? No..... you can extend your H1 beyond 6 years as many times as you want if you meet some conditions as per AC21. So it is possible for you to be in H1B for 100 years.
10years tax payed???? Yes because of the other reasons I mentioned. Also I know many who are still in que after 14 years paying taxes.

Collected from some other forum . Just google search your name combinations ( within quotes ).
For eg. if you have FirstName MiddleName LastName .
The search should be ( put within quotes )
"FirstName MiddleName"
"FirstName LastName"
"MiddleName LastName"
and all the reverse combinations.
If you get hits in 100s or 1000s , yeah you can wait 2 -3 years.

This is not about forcing USCIS into doing anything. The sole purpose of this is to bring awareness in mainstream media(and in doing so the american public) to the need of reform in american immigration system for skilled migrants. Immigration reform is not just reforming illegal immigration but this is one of our chances to put focus on legal employment-based immigration.

Why should I be embarrassed about protesting how sheer incompenet USCIS/DOS decision making is on this visa bulletin fiasco? about how my tax dollars and my application fees are spent by these departments?
Infact for people to be coming out of thier little cubicles to protest on something they feel is injustice says something about how embarrassed the government bodies should be about thier failure in doing their job. I have no shame in expressing an injustice done to me.

My PD is Jan 2006(been living here since 99). When Visa bulletin became current, my only expectation from it is that my wife can start working on EAD. I don't think anyone who was planning to apply for 485/EAD/AP based on the old july bulletin realistically expected that they would get their greencard in few months. This outrage is only that USCIS/DOS couldn't keep their house clean in how to solve the unused visa numbers and insensitively moved the dates forward and then backward causing emotional strees and hole in our bank balances. They did us wrong and might do it again.

Hi All,
I am on a business trip to Chennai and I was interviewed for my H1-B renewal on Dec 6th 2007, unaware of the PIMS as it was not mentioned anywhere on the website that it will take this long to receive the passport. I was granted my visa within few minutes but till date (Jan 1st, 08) I have not received my passport. Was interviewed at the Chennai consulate. It has been heights of frustration as I had to spend all my Christmas holidays and New years at Chennai with all my fly being in US. I was supposed to return to US on Dec19th had to postpone my tickets to Dec 24th and then to Dec 29th. Now finally I have cancelled my tickets as it was costing me $200 every time I modify my itinerary.The US consulate, Chennai keeps on extending the processing time from 3 to 7 to 10 and it has been 15 working days already now, but still no passport in hand. Last week on Friday (Dec 28th) got an email that it might take additional 7 working days, huh ! Good thing is my company is in Chennai so atleast I can go to work or else it would have been really painful.
Was anybody else interviewed at Chennai during that black week ??? with similar situation ?

what is the meaning of staff augmentation case? He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.

The letter campaign resulted in 5000 odd letters from the entire EB community. This included efforts from some very hardworking IV people who did not spend time on the forums but went out and collected 100s of letters, one collected more than a thousand letters. So i am guessing that not more than 2000 EB folks got their collective butts to participate in the letter campaign.
if you expect EB2 I and the so call US educated (i am too, hence i can use 'so called') folks to stop chatting on the forums and send money and letters in the tens of thousands, then please tell me want you smoke --- i would like to inhale some of that magic too.
good luck towards your efforts. if you make it happen then, in all honesty, i would also like to nominate you to the core team, if you dont then i have a bridge in brooklyn that i want to sell.

Hello every one,
I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:

Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.
Agree with this approach. I'd rather ask big and settle for less than ask for less and settle for nothing! We really need to emphasize the point that we have been here for years legally paying taxes, other fees imposed on us NOT knowing the end state. Remember only the squeaky wheel gets the greese. More over there is never a good time, at least I have not seen one in the past 13 years, time always bring new challenges and issues but unless we speak up we dont make it to their priority list for consideration.

Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.
Agree with this approach. I'd rather ask big and settle for less than ask for less and settle for nothing! We really need to emphasize the point that we have been here for years legally paying taxes, other fees imposed on us NOT knowing the end state. Remember only the squeaky wheel gets the greese. More over there is never a good time, at least I have not seen one in the past 13 years, time always bring new challenges and issues but unless we speak up we dont make it to their priority list for consideration.

I am joining Law Suit. I am leaving this country, if they make it 'U' for Eb2 and Eb3 for India.
i don't see a point here. they no need to approve the cases if no visa numbers but what wrong to accept. thoguh I am effecting by this my feeling is that this is just a rumor.

I am going for concurrent 140 & 485. Can I apply for EAD and AP now? or do I need to have my 140 cleared before I can apply for EAD and AP?

I am also in the same situation. Recently I changed the employer. My new employer is going to file I-140 and I-485 using the Labor substitution.
I also want to file EAD and AP but the company attorney is saying it is safer to file the EAD and AP once the I-140 is approved. Can any one please answer this is true or not? Should I wait for I-140 to be approved or should I try convince the attorney to file EAD and AP also along with I-140 and I-485.
I have one more question which is if We do not file the EAD and AP along with the I-485 and once the priority dates are retrogessed. Can we file
EAD and AP even though the priority dates are not current.
I would appreciate the answers.

Hi Ron,
My Priority date is Jan 2004, EB3-India category and i have an approved I-140 and have applied my 485 during July 07. I have sent my EAD and AP for renewal which expire in last week of September. My spouse is in EB2-India having pd Dec 2005, also applied I-485 (140 is approved) during July 07 and has applied for EAD and AP renewal, which expire in last week of October. We both applied independently and are using our H1bs and not EAds.
Since my spouse's PD is going to be current in August 2008, I was planning on applying for a second 485 as a dependent on my spouse's application.
I know that two 485 applications causes issues. I want your recommendation and also will my application affect my wife's processing time or create issues for her.

You don't need to file a new I-485. Make the CIS aware of your spouse's case and your eligibility under it as a dependent. Ask them to cross reference to the two cases.

The total number of applications excluding EB2, EB3 are 7,653.
The total visa's per annum -> 140,000
Considering that there would be more applications during the year from non-retrogressed countries/categories ..it is evident now that there won't be more than 5K such applications. On pessimistic side even if we consider 10K such applications, The visas available for retrogressed EB2 and EB3 should be around 120K this year.
Total pending EB2 is 74,932. So EB2 should be Current for all countries this year.
EB3 should get around 40K visas this year.
Any one disagrees?

HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.
The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.
If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.
If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.
I see in Capital Ones' career website they only have the restriction
"Capital One will not file non-immigrant visa petitions for alien workers."
Need to tell him that
1- EAD does not involve filing any petition on your behalf
2- Making a rule to hire only Citizen and GC with no security reason is as discriminatory as not hiring based on race (DHS opinion not yours)
3- You will not let something like this go quietly (try to put that point politely, but they may see it as a positive thing that you are determined and have the courage to stand up for what's right)

Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..
What does EB-3 thinks..we can send flowers to these guys and also to Charles Oppenhiemer...
