    late last month my father passed away and I had to fly back to Australia to attend the funeral. My lawyer and I were already in the process of preparing my i485/ead/ap. They arrived at the service centre on may26 and I left the US shortly after midnight on the 27th ( talk about close). My lawyer told me that as long as I was present in the US the day that the Service centre recieved my applications, I was ok. I also had my L1 re-stamped in Sydney before returning.

    So based on my experience, no you dont have to wait for reciept of filing, just must be in US when filled.

    Ok. I am finally beginning to see your point. If the objective of your exercise is to eliminate alleged non-genuine EB2 jobs, that really don't exist, but are simply advertised just for the sake of porting by unscrupulous companies who stand to gain money by this, then you certainly are making a valid point.

    But I still do not understand how a lawsuit will help? Was the labor-sub elimination the result of a lawsuit? Also, I would be concerned about lots of other valid/genuine companies who really have jobs for BS + 5 years experience ...?

    The argument is same for why labor substitution was done away with. The bottom line is it was abused.

    Yes. No one has bothered to go after DOS for misinterpretting the AC21 rule in allocating immigrant visa. Many people (EB2-India) raised their concern between 2003 and 2006, as DOS is not correctly following the rule and allowed the spillover to go EB3, when EB2 was in high demand particulrly from India. Even IV core did not go after DOS. As you mentioned, lawyers has no incentives. EB3 has enjoed between 2000 to 2006 (from the mercy of DOS). For example in 2006, EB2 got about 25,000 visas abot 20,000 visas (from EB2)has gone to EB3-ROW.

    IV from my interpretation is about ending retrogression and increasing total visa numbers and not about reallocation of visas and spending resources on a zero sum game. This issue should have been taken up by affected individuals. I'm sure they did it though because DOS has awakened to the fact that they were not following the law.

    Recent approved 140s (i.e. sept 2006 or later) has A#. Not all Approved 140 has A#. So don't worry. Earlier applicants used to get A# after filing AOS. Still in AOS process, CRU[one dept of USCIS] will verify the written A# or assign new to each applicant.

    I got the following response for Ombudsman for AC21 mail sent to them a week ago. They need Evidance of I 485 denials to discuss with USCIS. The following is the mail I got. People who have been affected already. Please share this with Ombudsman..Let's keep the momentum going..

    "It is not possible for you to be her derivative as well as your own primary, and vice versa. It would require the filing of 2 I-485s and this causes nothing but confusion on the part of the USCIS. You have 2 choices. You could pick a case that you are going to proceed under, most likely the one with the earliest priority date, so long as there is confidence that the I-140 will be approved. Or, you can hedge your bets by each filing as your own primary because if one of the cases falls into a problem, the person can switch to be a derivative, but could run into a problem if there were not current priority dates at the time. But, so long as your both remain in H-1B status, and not use EAD/AP, that is minimized"

    Murthy's words are not so clear. Other posts have her quoting "it's not recommended to file two I-485s", whereas here she says "It is not possible for you to be her derivative as well as your own primary, and vice versa.".

    Not recommended means "USCIS allows it or there is no clear memo from them so try at your own risk"

    Not possible means "USCIS does not allow it. Period."

    Bhai logon... mera bhi number aagaya... I got the the approval email and status changed to Decision (for me and my wife).

    Best of luck for those waiting...

    FYI: I opened SR on Aug 4th... Yesterday I got response that my GC is approved (but the status online was still Initial review) and now today morning my status changed and I got approval email and an SMS too.

    Given the above, I seriously think SR works. They must have checked my SR and then approved my GC.

    no, the idea is; if you cry for gold you will atleast get silver. When the point is raised that people have been living here legally, paying taxes, ss, owning houses etc etc for 10 years!! What more is actually needed for citizenship?? The idea is to highlight that legal residents (many of them) have been here for ever!! 10 years is almost 15% of an average life span!! If only this thing is highlighted in some strong news papers. Isn't this protectionism at its worst. Us is complaining about labor laws in china???? What the heck is this here??? You pay taxes and ss and medicare etc for 10 years and then you are asked to leave??????????? Isn't this slavery??? Either take of the requirement that workers on visas have to pay the required ss / medicare etc or assume responsibility for having taken their hard earned money and let them in as soon as possible into the society.

    somebody with skills in finding out stuff should research on how much money per year is contributed by the working h1b employees and given the numbers that are sent back how much is actually "stolen" from them. I once again say "stolen" from them. If they are sent back they should atleast be entitled to all the money that was "ilegally" taken from them.

    If they were submitted on 8/30/ and it's not cleared yet and your derivatives are cleared then more than likely you are stucked, there is some probability that you might be cleared in few weeks depending on number of hits generated against your name and avaialibility of the documents needed to be refered by fbi to clear you. However you dont need to worry much because now a days fbi seems to getting work lot faster then it used to. Also since july fbi has increased the fees that they charge USCIS to do the check which has increased the staff at NNCP and so the efficiency. I would suggest for you to wait 60 days and try again. Hopefully you have good news. I have been waiting 35 months.

    After filing I-485 one single thing which gives butter-flies is NC. Just a Look at your and CAdude posting shows how terrible is NC and how difficult it is for those unlucky ones to bear this uncertainty. God bless all !!!

    To let you all know,
    There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.

    LOU DOBBS: Well, I can recall what was said if it�s at all helpful. I said that according to a study�I didn�t use the attribution, but according to a study that Jorge Borjas at Harvard University had completed, that the cost of excess immigration into this country amounts to $200 billion a year in wages, that the cost of incarceration, medical care, social services approximates $50 billion in this country per year. And the reality is that about a third of the crimes that are of those in state prisons�federal prisons, excuse me, federal prisons, are�I�m sorry.

    AMY GOODMAN: Are�?

    LOU DOBBS: Are those who are in this country illegally.

    AMY GOODMAN: Let�s play it.

    Let�s say the number is eleven million, although some studies put the number as high as twenty million illegal aliens in this country. That not only amounts to a shift of six to ten congressional seats among the states based on the population of illegal immigration. The fact is, those illegal aliens are costing our economy $200 billion in depressed wages for working Americans. It is costing $50 billion a year in social and medical costs. And it�s costing us, no one knows precisely how much, to incarcerate what is about a third of our prison population who are illegal aliens.

    AMY GOODMAN: So, Lou, you said a third of the prison population are illegal aliens.

    LOU DOBBS: Right.

    AMY GOODMAN: The fact is, it�s something like 6% of prisoners in this country are non-citizens, not even illegal, just non-citizens.

    LOU DOBBS: Right.

    AMY GOODMAN: And then a percentage of that would not be documented.

    LOU DOBBS: Well, it�s actually�I think it�s 26% in federal prison.

    AMY GOODMAN: But you said of all prisoners.

    LOU DOBBS: I said about�yes, but I�and I misspoke, without question. I was referring to federal prisoners.

    AMY GOODMAN: But you didn�t say that, and so it leaves people with the impression�

    LOU DOBBS: Well, I didn�t, but then I just explained it to you.

    AMY GOODMAN: But you have a very large audience on CNN.

    LOU DOBBS: I mean, what if I were to sit here and just hound you because you said I was anti-immigrant, when I am, point of fact, I�m anti-illegal immigrant, and it�s absolutely a matter of fact. We could quarrel over the terminology, if you want. But why should people of good faith and intelligence sit there and be so absurd about it?

    JUAN GONZALEZ: No, we agree on that. But this is precisely the lumping of illegal or undocumented immigrants and legal immigrants in one category that�s a problem�

    LOU DOBBS: Right.

    JUAN GONZALEZ: �because, for instance�

    JUAN GONZALEZ: �the total percentage of the non-citizen population of the United States right now is about thirty-five million, 12% of the population.

    LOU DOBBS: What do you suppose the confidence level is of the United States government in the number of people in this country illegally, the number of people�

    JUAN GONZALEZ: We�re assuming now�the legal population is pretty well documented, right? But the�

    LOU DOBBS: Documented, undocumented.

    JUAN GONZALEZ: The legal immigrant population is pretty well documented. It�s about twenty-three million. And then you add maybe another eleven to twelve million of the undocumented population, and you get thirty-five million. The point is�my point is this: if 12% of the non-citizen population of the United States�non-citizens comprise 12% of the population. They comprise 6% of the prison population. That suggests to me that crime rates are far lower among non-citizen immigrants�legal and illegal�than they are among the general population of the United States.

    LOU DOBBS: Can I ask you a question?

    JUAN GONZALEZ: You have raised the issue of crime�you�ve raised the issue of crime in relationship to immigrants.

    LOU DOBBS: Well, silly me, silly me. MS-13, all sorts of gangs. You know, the fact that Mexico is the largest source of methamphetamines, heroin, cocaine, marijuana entering the United States. Silly me for bringing up crack.

    AMY GOODMAN: But, Lou�

    LOU DOBBS: But may I ask you a question?

    AMY GOODMAN: I think you agree�

    LOU DOBBS: May I ask this question�

    AMY GOODMAN: I think you would agree�

    AMY GOODMAN: �that facts matter.

    LOU DOBBS: Of course, they do. Absolutely.

    AMY GOODMAN: And so, if 6% of prisoners are immigrants�documented and undocumented�and you said 30% of prisoners, a third of the population of prisons in this country, are prisoners, it conveys a very different sense.

    LOU DOBBS: Different meaning.

    AMY GOODMAN: And as you�ve pointed out�

    LOU DOBBS: I agree.

    AMY GOODMAN: �you�ve done hundreds of shows on these issues.

    LOU DOBBS: More than that. More like thousands.

    AMY GOODMAN: And that reinforces the feeling that people have, who watch the show�

    LOU DOBBS: So, your point is?

    AMY GOODMAN: �either they believe you or�either they don�t believe you, or they believe you and are being fed wrong information.

    LOU DOBBS: Well, I don�t�you know, I think it�s important for all of us, because, as you say, I�m�we�re all interested in the facts. So let me ask both of you, please, a question that seeks a fact: Does the United States government and do state governments inquire of their prisoners as to whether they are legal or illegal, and can they under the law? Or are these estimates that we�re talking about?

    AMY GOODMAN: Well, if the government doesn�t know, how do you know?

    LOU DOBBS: No, that�s as straightforward question.

    AMY GOODMAN: How do you know?

    LOU DOBBS: Well, because in the federal prisons, they are permitted to make a decision as to whether or not they can ask if they�re citizens or non-citizens, but cannot ask if they�re legal or illegal. So it is, at best, a projection. When Juan says eleven million to twelve million illegal aliens, you and I both know that the Bear Stearns study suggests twenty million people. There is no one in this country today�that�s why I referred to the National Intelligence�

    AMY GOODMAN: And the Bear Stearns study has been critiqued over and over again�

    LOU DOBBS: By whom?

    AMY GOODMAN: �by the top economists.

    LOU DOBBS: Oh, come on!

    AMY GOODMAN: Bear Stearns study, saying it is wildly exaggerated, that their�

    LOU DOBBS: The National Intelligence Estimate is closer probably on Iran today than it is on the makeup of the US population today. I mean, if you want to talk about this nonsense, I mean, that�s what it is.
