I have a quick question, Some of you had an older EB3 pd active, filed 485 and then either ported or have used a newer EB2 and gotten approved and Greened.
Now, knowing USCIS uses outdated software, the question is are these people that are greened, taken out from the so called "queque" for EB3?. And then hopefully the line gets shorter for EB3s?.

A lot of lawyers try to preempt a possible RFE by including "AS MUCH AS POSSIBLE" documentation. 3 years of tax returns prove nothing more than what 1 year of tax return would prove.
Also, having a tax return of 2004 doesnt prove that you were in status at all times during 2004. Tax return shows total income that includes salary, bonus, deductions etc, and even Einstein cant figure out the immigration status in 2004 and whether the candidate was in good status at all times just by looking at the tax return.
Some lawyers send many years' tax returns, thinking that it might pre-empt the RFEs. Some lawyers send only whats neccesary. I've heard that one of the lawyers in New York doesnt even send employer's letter. That means, basically nothing from the employer. And he too gets cases approved.
Overloading the USCIS with a heavy file, sending a ton of things in addition to what they expect, may be a good strategy if you believe that it might thwart a RFE (and the delay caused by RFE). However, sending too thick a bunch, would also make your case look like a "difficult" case. (my belief, I dont know but just common sense would indicate that thicker bigger files are complicated cases if you give it a first look). And what that means is that it will get delayed because the CIS ombudsman report has documented that officers tend to work easy cases first (get the low hanging fruit first) and beef up their performance statistics by doing more cases in less time. Therefore, the complicated bigger cases that should be work on first, instead get worked on last.
So think a little before sending USCIS 20 pounds of paperwork. More paperwork and overwhelming USCIS with documentation may not mean faster RFE-free processing. (Again, my belief - something to ponder about. But do what you think is right and what your lawyer tells you. I am not a lawyer).

I believe that as long as interviewing is concerned companies may have the right not to interview particular kind ("EAD holders" for an example) and interview particular kind ("GC Holder for an example..)
Not a lawyer, obviously :) , but the first line on I-9 about discrimination covers "hiring, discharging, or recruiting or referring... It is illegal to discriminate against work eligible individuals."

Let us talk about the "skills" introduced by H1/L1/offshore companies
a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

Hey Hunter, were you born in this world with C++ knowledge baby? I have said to some of my managers and also clients that I was interested in the job because I wanted to ramp up skills in that area and they were more than willing to give me that job.

Last time I had travelled by British Airways in 2004 and I have made a resoultion for never tavelling with them again. We had a baby 2 years old and he was cranky and my wife asked airhostess to clean the feeder and she refused, saying that 'Mam we don't do this!'. Point is that they don't treat us well even though they get lot of income on routes to India. Also, look at those crappy old planes they deploy on these routes. As someone else said in this thread that it is time for Indian Govt. to wake up and be stiff on such lapses. I am sure they will listen, as they can't afford to lose big bucks coming from India anymore.

Maybe this qn. was answered before. Tried to look for answers. But was not lucky to find the exact answer. Also, my qn seems a bit out of context w.r.t this thread (I dont even know how to start a thread).
Anyways, my qn is:
If one starts actually using his/her EAD via (eVerify or signing I-9 form), then how will the USCIS know that he/she is on EAD and not on H1B anymore? As per the link below, the I-9 form stays with the employer and shouldn't be submitted to the USCIS.

So, as a worst case scenario if he asks me to use EAD only, then I'd be forced to use it. So, how will the USCIS know about that? Lets say, I use it on April 15th. Then will my H1B inactivated starting April 15th? Where and how is it recorded? Just curious.

USCIS would not come to know and does not care to know. USCIS knows that it has issued an EAD to you, Now whether you use for a job , do not use or open the locked door with it, it does not care. Yes, while processing 485 if it generates RFE then depending upon the nature of RFE if your new employer is contacted for employment proof, perhaps USCIS may know that you are really using it.

Well, I am no lawyer, but IMHO, it should not be an issue. Several people have posted comments regarding the A# and have found that some have it, some don't.
There is a post somewhere that explains different types of A#. I am still a bit fuzzy on this.

Good idea kumar1, once this rollercoaster ride is over and settled.. we should start an anti-Lou Dobbs Youtube session. I will definately contribute in whatever way I can.. uploading videos, editing etc.

Friends, IV�ians and fellow sufferers,
Today we received our physical Green card; 63 years since my motherland got her freedom I got mine. Its been a long journey and I am glad that I can shut this chapter and go on to the next..
First of all let me tell you that the mail that you get the card is as incognito as they come. Its not in the USCIS envelope, looks almost like a credit card offer. Wife was almost going to shred it but felt the card and opened it :). Its actually green. With the date of birth mentioned a gazillion times. Magnetic strip, hologram and all that kind of jazzy stuff. I have no freaking clue where they got the picture from, its not what I submitted with the I485. It should be the one they took while finger printing in 2007.
Finally I popped the cork off a bottle of Champagne that I have been saving for this occasion and have taken more than a few morsel sips of the bubbly. (please pardon any excesses I might make in this post :D). Now I can chart out my career as I want to with no constraints to cap my potential. I can attain full self actualization in whatever I decide to do and also hopefully contribute more to society both here in my karma bhoomi and back in India my janma bhoomi.
If I may paraphrase Jawaharlal Nehru � when the world sleeps (its 12:45AM eastern); I awaken� !!
I have contributed both financially and with my time to IV. I will continue to do so. I wish all of you the very best and hope the ones waiting in get their GC soon. Keep the faith.

Isn't is written somwhere that if the last day of a month falls on a saturday or a sunday then they accept the applications on the next working day even if it falls under next month.
Last day of June is a saturday and so won't they have to accept the june applications on Monday???/

Someone please consolidate all information and create a campaign for this. Now is the time to follow up with anybody on the full committee with whom we have previously met or been in contact. Don�t call people who are already cosponsors. Only select people in the committee that are not co-sponsors. Make sure to say that you are a member of immigration voice so that it complements our lobbying efforts.
Please pool your energies and create a list of people to call, phone numbers and what to say. Any moderator will add in the first post of this thread.
Please keep posting your feedback on the thread when you have called. Once the campaign details are posted, post them on other websites too.
Please make this thread sticky and create red flash iteam on home page

The real message in this thread is that you should check what is required by the countries you intend to transit BEFORE you buy your ticket.
It seems to me that an individual should take responsibility for his own actions rather than trying to blame a particular country for a long established requirement for a transit visa.

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?
