Our cases were approved on Sep 21, 2010. Received approval notices on Sep 25, 2010. But did not get the Cards yet. I am planing to travel next week. So I went to local USCIS office and got the I-551 stamp on my passport. Can you guys suggest me what other documents I need to take along with me if I don't receive the cards by the time I leave. Also pls let me how long will it takes to receive the cards.

+ve skin test does not mean anything.
You can be +ve if
1. If you ever had TB
2. If you ever had TB medication
3. If you ever had TB Vaccination
If you are +ve, you need to do chest x-ray to verify whether you have TB or not. Tell your doc for chest x-ray. For me, I knew I will be +ve and so I told my doc for x-ray at the first time and did not have skin test.
I Got Positive Skin Test. What Should I Do Now? Please Inform Me.

How do you guys know that 12K visas will be allotted in one single month(May)? From USCIS point of view, won't it make sense to keep some numbers as reserve, if the EB1 picks up in the 2nd half?

Final update on this issue.
Here is what I have been told. Please feel free to check with AILA or your lawyer. They may have more info.
In general, if an employer applies for a permanent labor certification for an individual with the Department of Labor (DOL), while DOL has already certified one or more positions with same or different employer for the same individual , it will be subjected to more scrutiny to prevent any fraud.

1. Good talent is sought after. So if one is really good, multiple companies would want to get them to work for them. That would result in multiple labor petitions.
2. Individuals who are scared (company not reputed; they had issues in the past; or any other reason) tend to approach multiple companies and have them file a labor for them as a "backup".
3. Someone gets laid off from their initial sponsoring company finds another sponsor and files a subsequent labor.
If DOL scrutinizes such petitioners more than others, then its good. That will weed out pretenders; but also on the other hand, that will put genuine candidates petiotions into a pre-adjudicated state.
But I do not think a government agency can risk getting caught doing that. Their motive has to be to build standards that can be applied equally to all applicants across the board. They should be able to catch issues with any application, not just of those who are doing multiple LCAs.

My lawyer requested that I find all copies of my I-20, OPT EAD, H1-B's etc. My question is do we have to submit copies of I-20, and OPT EAD for the Adjustment of status (I-485) stage ? Please let me know what you think ?
I-20 is from a university that accept students in the US. The F1 student visa is issued based on the I-20.

There was no communication between the consulate and my employer. I guess it was just luck.

I think you should be able to file the 485 yourself. The form is simple. If you can get a lawyer to do it and get all the appropriate 140 approval docs- the better, but I don't foresee any issues "doing-it-yourself".
Advace Parole is a travel document that lets you return back into the US without a H1B stamp on your passport. The AP has to be renewed every year along with the EAD (employment authorization doc) card.

and of these 40180 EB3 India will get just 40180%7= 2812
Folks, only 2812 Visas for EB3 India and EB3 is not going to get any spillover this year!!
You are wrongly mixing "country limit 7 %" into a "category limit 28.6%". Please read visa bulletin content.

I would like to express my support for the bill and would like to request the support of Congressman/woman for the bill. If you can pass the message to the Congressman/Woman, that will be greatly appreciated.

pending for year 2011.
5) Quota for EB3 --> 5.72% x 140000 = 8008, no spill over. Pending: 62607 -8008 = 54599 applications will still be pending
and pushed to year 2011.

4) Quota for EB2 --> 5.72% x 140000 = 8008 + 11692 =19700, Pending: 211, So total 19489 applications will spill over to
EB3 category.
5) Quota for EB3 --> 5.72% x 140000 = 8008 + 19489 spillover = 27497 � 7878 Pending = 19619 visas Extra.
6) �Other Workers� � Pending: 8415 TOTAL UNUSED VISAS = 19619-8415 = 11204 UNUSED VISAS will go to the quota

TOTAL UNUSED VISAS = 15463 + 1635 + 11204 = 28302.
Assuming these unused visas from Philippines, China and Mexico will be used for India, ROW equally India will benefit additional 14151 VISAS this year. Assuming all of these go to EB2 India Pushed down figure for EB2-India for the year 2011 will be 28346 � 14151 = 14195 pending EB2-I applications ready to go to year 2011.
So per your theory 8008 people who filed in Eb3 should get approved which should bring it to 2003? for EB3-I by end of year? :rolleyes:

One more thing.
If you decide to apply multiple 485s with each other as dependents, then file just one first. Wait. Gets its A number and put that number in the other application. This way you will cover one pitfall of multiple filing. It will not cause confusion at USCIS end.
one thing to consider though: with the number of 485 filings that are expected in July, receipts are probably going to take 8 weeks or longer to come through (just ask teh H1B filers this year). By then the PD for the other spouse would have probably retrogressed. Another thing to keep in mind...

Please check with some other attorney too. As per my understanding, you can not file H1 from your own company.
I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..
