Contact a good immigration attorney immediately. Being out of status is a serious violation and her access to US can be restricted due to this. I doubt very much that her 539 will be approved.
Partly correct.
As long as I-94 dates are not expired, out of status does not restrict future entries to US.

I oppose this idea. Let us all focus on Greencards. People who got GC should be helping us who do not have GCs.
GCperm used to write so much about Greencard campaigns but as soon as he got his GC he is on this thread talking about citizenship. This shows selfish mentality of some people. All greencard holders should work on helping people get GC behind them. People should not be allowed to abandon us and work on something else. We are not even getting Greencards and you guys want to work on Citizenship.
First help us all get Greencards.

If you look at IV members who are advocating for clearing this green card backlogs, by volunteering for the cause, they are not looking at how it benefits them, but how they can pave a way for future applicants.
When it comes to citizenship it is more difficult as I have personally seen people who are willing to continue with green cards for more than 20 years than taking up US Citizenship because they are more emotionally connected to their birth countries.
Anyway, note if you are sure of the fact that you want this campaign to continue even after six years of you starting it(by then you can become a US Citizen), then you should be promoting this.
Example, Aman Kapoor who started IV, got his green card and still fighting to clear the green card backlog mess.

I am on H1B visa. My parents due to medical condition cannot take care of themselves. Can I get them on H4 visa as dependent? I would like to keep them for 2-3 years in US and take care of them. Please let me know my options.

your anguish is so very legitimate. i, for one, feel truly bad for you.
you deserved relief and nothing has come so far.
there is no harm in venting your frustration on a thread, i don't think anyone can blame you for feeling screwed.
but peace friends, iv's fight is not over by a long shot. we stand together for relief for all- including you. i hope that BEC releases the approvals quickly, and you guys will certainly be current. in fact you will have GC long before many filing 485's now.

Update from Infopass at Cleveland office - We were told that our files are with an officer right now. Also, we called to speak with a rep. and were told that our Service Request will be processed on August 18th (we initiated it on August 3rd). Apart from this, we have contacted both our senators and congressman. In addition, I sent an email to NCSCfollowup.nsc@dhs.gov and got a standard reply. I think I have fired on all cylinders and will be hoping that one of them will work.

For Those who had spent more than five years in the US paying Federal Taxes, are highly skilled (MS) in STEM fields and has been delayed due to name check or Backlog etc. 5 (or 3 yrs) period should be counted from the date of receipt of I-485. (They definately need to get GC before they can apply for citizenship, counting this period)
Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.

There are thousands of anecdotes that I could share. My best is the look of shock on one of the IV member's face when I asked him to escort one of the lawmakers who attended the Monday evening reception dinner. We couldn't believe that we see him on C-Span and he is standing next to us and supporting our cause.
- Can you imagine the feeling when a lawmakers says I know about you guys. You are doing a good job. This shows we are visible in the Hill.
- I felt great when I saw the confidence on the smiling faces of IV members when they came out of lawmakers meetings. For those who missed this historic opportunity, I can't even begin to explain the change in mindset from the initial apprehension about visiting a lawmaker's office to, "Why do I only have three meetings set up, I want to fill in for others IV members who might not have shown up due to various reasons"
For those demanding immediate results when they themselves might not have showed up at the rally the answer is, we will get our green cards eventually. There is absolutely no doubt about that in my mind but these experiences and memories will be cherished for a long time. This is also important to me. This new "experience capital" which was initially present among just the core members has trickled down to other members, we are growing in strength and reach our goal soon.
I am glad I went for three days. I wish I could stay longer.

The following is from Hammond Law Firm. There is no cap for non-profit organizations.
The H-1b season is quickly getting closer. We now only have 6 weeks left before April 1. As you may recall, last year, all H-1b's were exhausted by May 26th. Why is there a group of people trying to portray "immigrants without GC buying a home and later letting it go to foreclosure due to job loss" as criminals ??? ( "extradited and put behind bars" , "must never come back to US" , etc etc) . US is a debt based economy and it relies on people spending money, hence bankruptcy is a perfectly legal procedure and your credit gets screwed , but that's it and the rule is the same for anyone, be GC holders, citizens, illegal immigrants, legal immigrants. Why discriminate against fellow immigrants ? only just because you can ? why not put the mortgage brokers who pushed inventive mortgages or the big bankers who got million dollar bonuses because their mortgage backed assets portfolio doubled to trillion dollars, behind bars ?
Give us a break. Buying a house or renting is a personal choice (I'm for buying if your rent is pretty close to the supposed mortgage payments) , and please let it be like that. Ya I know there might be peer pressure/family pressure , so what ? I also get asked sometimes when I go back to India as to why I don't have a GC yet, I just smile and say "I don't know and frankly I don't care" :)

Thank you for your effort. Recapture of unused visas will eliminate most of the backlogs (does it require a congressional approval or if anything can be done as a part of an admin fix). Anything that requires a congressional will be lumped with the CIR, we are a small group of people held hostage at the mercy of CIR.

So are we ready to create a group of 20-30 people who will schedule appts with their lawmakers and discuss overall IV provisions along with support for this specific bill?? Hundreds of such bills are introduced every year in Congress (this specific bill has been introduced several times in the past)..so we need to truly understand whether there is any appetite for lawmakers to vote for it..instead of re-assuring ourselves that this bill will somehow help us.
My lawmaker appt is on Feb 3rd. We need a structured approach with a proper group whose members follow up with each other and keep updates from lawmaker meetings. Not random posts on this thread, once in a while, that "I sent spam mails to all my senators..(mails that they will never read)". Lawmakers receive hundreds of emails everyday.
we need to create a grassroots rapport with lawmakers.
Appepite for lawmakers to vote can only be known when this bill moves forward. This time with Republican in majority I think it has better chances than earlier.
This bill has been referred to the House Committee on the Judiciary and which will refer it to Immigration subcommittee . I dont know the steps involved after that. However we can contact these committee members (112th congress committee members yet to be selected) and keep this bill in the forefront and not lost with hundreds of ther bills.
I guess we should be ready to make a Team of 10-15 people and keep our efforts directed.
