Will this be a problem?
I need answers to following questions.
1) Can i apply for mY wife's H4-B renewal while her H1-B application is pending?
2) What will happen, if here H1-B is approved after H4-B renewal is applied and before her Renewal of H4-B is approved?
3) What will happen, if my wife's H1-B is approved before H4-B renewal is applied. On what status will she stay untill Oct 2007. Does she have to go back to India and come back with a visa stamp?
Any other matrix?
thanks

How do you know that this year quota finished on first day because of Indian Companies? Do you have any proof to support your blame? And what is Indian consulting firms? Why is it ok for one group of companies to file for H1 and not ok for another group of companies to file H1? Why is it UNFAIR for consulting companies to take large number of H1 quota? Isnt H1 considered to be for the best and the brightest? Wouldnt it make more useful for the best and the brightest to provide solutions to many companies at the same time by working for consulting companies? Why discriminate against consulting industry?
Here is some information that may help you gauge the reality. There is lot of companies in US that would not fit into your definition of Indian Companies. These companies have filed for large number of H1s that too would have finished the H1 quota. If it is ok for an H1 employee to work for a shoe making company, then why is it UNFAIR for H1 employee to work for a consulting company?
Bottom line is:
1.) There is green card backlog for 6-10 yr. Any company would love to get an insurance policy that an employee will work for them for that long period. So one reason for this quest for H1 is due to delays in green card processing. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.
2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that the changes going to be introduced to fix the system will not screw us and complicate more the immigration process. is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. So Best of Luck for your ranting.
For the sake of clarity, I do not work for a consulting company. But I realize that this bill could potentially effect everybody on this forum. Also, I see a racist attitude in this bill against the huge consulting industry. And this negative attitude against consulting industry will have a snow ball effect into rest of the economy and society. I don't think IEEE took that into consideration.
I have no problem with the consulting business. In fact, I had been working on this in my home country. The problem is the way we are or would be affected due of some them are not so transparent immigration practices which are mainly from India.
Let see this case, a company sponsor a large number of H-1B to individuals that does not have real job offer, but look for real jobs after they get approved, while a second person does have a job offer but cannot get it because the H-1B quota was reached very early.
Does this makes those individuals the best and brightest, while the second person not?
Knowing that there are very limited H-1B available per year, do you think this situation is FAIR for the second person or his sponsor company?
From last year information, who are the top ten H-1B sponsors? What they have in common, their home country or type of business? And it is not a secret that more than half of the whole H-1B where issued to the top two H-1B sponsor companies combined, and in a very short time. You dont need to be very bright to figure out what will be their next steps to secure H-1B visas within their company. So I presume that all those top H-1B sponsors will compete again for their piece of cake, but more fiercely.
I have never mention to be in favor or against for any proposed bill. The apparently abuse of the system is what causing all this mess, which are the real more reasons to the anti-immigrant, but not my comments or your comments. For now it look like we will be facing a dilemma, not to be able to apply for the H-1B because the quota is reached before we can accept a job offer, or face stricter and harder rules that probably will make the application almost impossible. I only hope the H-1B can be regulated without impacting us negatively.

Unintentional, might be, but you did ruffle this topic of US Master's vs US Non-Master's with this rather sad comment (warm spit!). I dont want to go much further into this either but talking about something that you obviously dont know (useless subjects 'assembly language programming'), you havent added any valule addition here either. (Just FYI, even during peak recession, ppl with ALP skills were really very few because most of the direct recruits from '6 month NIIT courses' werent upto system level programming).
And btw, if think that a 6 month course in NIIT with a degree in tier 3 university is going to help get a job during times of recession, then i dont know what to tell you.
Yes, i do have an MS degree from the US and i did suffer lay-off during recession - bounce back, i did really quickly while i saw few ppl that only had '6 month courses from NIIT' suffer for long times without a job because all they had to offer was that...their six month experience at NIIT!!
Btw, i do appreciate all the work that you do and all your postings too, but i felt that i had to give a riposte to something that i find insinuating and written without a whole lot of thought....
Why do we always equate some educational qualification from some institute to capability? Remember Einstein, Bill Gates, Steve Jobs, Cornegie, Rockefeller.... list goes on.

"One can have a good quality of life in a small apartment...."
Not true - a small apt is a small apt no matter what. Yes, you can live with peace of mind in a small apt, and yes you can live happily in a small apt. This does not equate to quality of life. The "quality of life" in a 4 bedroom house with back yard is greater than that in a small 650 sq ft single bedroom apt ( if you put the same person who was happy in the small apt into the 4 bedroom house - even if his happiness level remains the same, his quality of life just went up)
Nothing against someone buying a 4BR house. I respect everyone's decision to buy whatever they can afford. I had been to one of my friend's 4BR home in North East during winter and felt like being in a igloo. The heat was set at about 62 to save on heating cost!
I'd rather have a 2BR apartment (or a 3BR based on need) and have a comfortable temperature.
One can buy a home but ensure one doesn't become 'house poor'!

You don't contribute because your issue of "name check" is not on IV's agenda?
No. The I-129 is submitted by your employer. Your leaving the country does not affect the H1 petition.
Only the COS will not be automatic in October, and you will need to get stamping or re-submit I-539 to validate your H1.
Hope you win the lottery!

Honorable Lofgren had brought about very valid points and it seems too good to be true. (pessimism)
But if this is true We are all in, in next few days. (optimism).
The Twist is if this is true chances are H. Lofgren will cut a deal, remember there are heavyweights on the other side too. Its too embarrasing for all of them. ( realism)
I wish my optimism comes true though, that way I can tell my children when they grow up as to who made the difference and stood up for RIGHT CAUSE and questioned WRONG DOING without fear and that would be Hon. Lofgren.

All that IV wants you to do is contribute atleast $20 bucks, and you dont have to do anything else. Just think of this..the core team might have already spent hundreds of dollars, and VALUABLE QUALITY time talking to people in D.C, organizing meetings etc at the cost of their personal time thay they could have spent with their families and loved ones. You dont have to go that far, just spend 5 minutes to sign up for recurring contributions, and who knows IV might be able to get something that might give you more FREEDOM for you to say good bye to those lousy employers, and live peacefully!
Come on guys, lets contribute generously for our OWN FUTURE!!!

While I agree with most of what you have said, some of this anxiety will be removed or minimized if USCIS has a published or documented way of going through with these approvals (like PD,RD,ND etc)instead of randomly choosing a case.

I am also a unlucky victim of labor backlogs. The details of my child are given below. It is imperative, for the sake of our children's future and welfare, that all of us join forces to make the lawmakers to amed the CSPA so that it benefits our children. They should not be made to struggle for no fault of theirs.
1. Your Contact Information: (Email at least; First, Last Name and Phone Number ideally)

I do not know if I am doing something against the rules of this forum, please excuse if I am. I am just a father trying to do something to protect his daughter; but I know that there are many other children who are or were under similar circunstances. I am not a lawyer. My wife, my daughter and I went to talk to our Representative Moran and our Senator Webb, but they are interested in numbers, cases, especially Virginia residents; but I think that this is something national. We (my family, I and anyone who wants to join us) can go to the office of the Leader of the Senate Majority or the House or to the office of any other committe leader and give them a letter showing numbers and cases, real families that are suffering and requiring them to do something about it. If you agree, I would suggest to prepare a small database with all the cases that we know, then prepare a letter and send it to the Congress leaders.
I think that we would need the following information:

Absolutely true.
EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1.

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.
You can email to Ombudsman at CISOmbudsman.Publicaffairs@dhs.gov providing all the detaisl. As a routine they ask to fill a form with your case particulars, explaining why something investigation should be done. Those forms are then sent to USCIS, who routinely give some absurd explanation.
In other words, it could help if there are lot of emails, or letters to Ombudsman (address and fax # can be found on their website - google for it). Emphasis should be on USCIS inefficiency, not following the sequence, PD's etc., if several example cases (via filling forms as they need those for privacy reasons). Give simple examples, such as in May 07, EB2-India cutoff was April 04, now in May 09, it is Feb 04, whereas in the meantime many with PD's in 2005 and 2006 have been granted visas. Why?
Note that PD's, a very important critieria for retrogressed country cases, are not anywhere other than the paper applications. Therefore, USCIS/DOS have no way to know who should or should not be processed next. They claim that they process cases in order they receive (paper filings). By processing, they mean they check all docs (birth certificates, medicals, photos) AND Priority Date currency. If at the moment your file is being looked at, your PD is not current, it is put aside. This completes their processing of your case, and they move to the next one. What happens to cases put aside in this way, is not defined or clear. In last quarter, they ask permission to work on larger number of cases (which they get via widened PD cutoffs). unfairness is evident with this process.
Why?
