The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

If one has rental income, interest income and captial gains from the stock market while on H1-B, does it affect if the person transfers status to H4. Is income from above sources for a H4 person ok ?

I had renewed my passport from Indian embassy in Houston last month, I have sent Tatkal fee and all documents and sent it on April 18th and I got my new passport and cancelled old passport on April 19th. It was total surprise.

I have been trying to enquire about the status of my passport application. I tried all different tel numbers listed on the website. Nobody picks up !
Did anyone call CGI-Houston recently ?
If so please provide the number. Thanks !

I had similar situation recently. I tried calling CGI houston several times with the nos. listed on the website and no human would answer. If you are homesick, these nos are perfect to give a call. It would just play you a long Indian Classical music over and over again. My ears were still ringing with the music after the call, you can imagine how many times I had called!
Once I was lucky to get through, but not for much help. If anyone picks ups by chance, they would be rushing you like anything and refer you to consult the website.
It is amazing!

Slammer, if you got visa number last year you should have gotten an interview months back, UNLESS your consulate appoinment schedule is backlogged.

Sorry, should have said that the NVC had visa numbers for us - last year. Of course we won't hear anything from them until our PD becomes current.
But thanks for the tip to simply call the NVC and inquire about the status of our application, until now we only called the automated system and sent inquiries by email. Talking personally to someone might give some more information than the automated response :"Numbers are not yet available."

I agree with your message that immigrants should clear their dues before they leave. I'm of the belief that, even if they complete 36 points in Social security when they leave, they should leave honorably without any dues/liabilities. That is the choice we made knowing the repercussions.

I am completely opposed to non-GC holders buying a house. Tell me something - tomorrow I get out of status and can't find a job for 6 months and finally decide to leave, you think I am a fool to use up all my savings to disburse loans??? Its unthinkable. 6 months without a job is not far-fetched, I know several folks who were in the this situation. Without an employer my immigration status would be invalid. EAD/H1-B is not GC. Either you are a gc holder or you aren't.
Buying house is optional, paying off the mortgage is NOT.
I would buy if my family had dual incomes, we had our permanent resident status, long term plans to live in the US, income to house ratio was right (1:3 or something reasonable not 1:7 as it was/is with most middle class folks in the Bay area) and so on.

While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.
In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.
Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.
Besides when we filed in EB3 categories there was no retrogression and hence no one cared or else we also would have filed in Eb2 and got our GC.
I think time has come for IV to lobby for help to EB3 people specifically since EB2 is almost done .

PERM approved in EB2 today after 4.5 months...now I'm officially EB2 and in the long wait line. Glad that my PERM got approved.

You are talking as if people are doing favour for others. You are here because you are stuck in immigration limbo as I am. I am not doing any favour for any one but myself. Is it very hard for you to understand. I am sure the brightest and highly educated can understand they are the losers if they are not participating.
People have various reasons for not participating ...its simple basic PR...IV as an organisation needs to frequently remind them of the good work IV has accomplished in maybe a regular newsletter...list out various needs that need attention and require volunteers for clearly defined roles...and be positive and coherent when replying to member's queries. Lashing out at members for asking simple questions is huge "no-no" for any organisation.

I've contacted NVC and the Consulate many times. Indeed, they just followed the rules and they don't consider it is an extraordinary case.
I have contacted congressmen and senators to try to highlight this issue and to be totally honest most of them have so little knowledge of immigration law they do not even understand the problem.
The CIS do not care, they follow the rules.
It is attention much higher up that is needed on Capitol Hill and someone who is willing to make it a REAL issue.

AFAIK the H1 Masters quota of 20K is open to just U.S. Masters degrees, not even PHDs from Indian universities qualify for it.
however for EB2 for instance they dont care where you get your masters, so its a mixed bag. Basically USCIS follows the law, and its upto the lawmakers to decide the nitty-gritty of a particular law.
If you have US masters degree then it is very esay approval but with non-us masters you need to provide lots of supporting documents because they are scrutinize more.
