So what a wonderful trick,....in April I am current based on the Visa Bulletin, but now their processing has moved backwards to June and that means no luck for all July filers.....what a joke....:(

My employer says that he has lodged my PERM in July 2008. As yet there is no news and neither does he provide any information regarding the status. Is there anything I can do to find out whether the PERM has been lodged at all? What are my options?

I'm all for this. This is very close to my heart. I probably care more about this than I do, my 485 approval.(can't have one without the other, I know I know. But still.).

What more "assimilation" do they need to do?
I definitely think that the following should be the criteria for eligibility to apply for citizenship,
- An approved green card
- 5 years of continuous U.S. residence starting from the date the 485 application was received.
Let's do this.

DOS allocates GC numbers to USCIS adjustment cases only as the point of approval is reached. DOS can set/move/retrogress PD based on info provided by USCIS about number of cases at point of approval.
USCIS is not able to provide a good estimate of this number because
it can not calculate this number based on USCISs workload, and
it does not know the number of cases DOL will send to them. DOL again can not calculate the number of cases (it will send to USCIS) based on DOLs worload.

Comments are welcome.
However in order to work on an issue, the push and support must come from members needing it. For that we will need support of Greencard holders who think that this an issue for them and they are willing to participate and support IV to go all the way. Right now we have our hands full with current IV agenda and need to accomplish those with our limited resources

texcan, it is a bit off topic but it is so funny.....
This really captures a lot of what all the "desis" do. Eat a lot of food and watch movies.
Me and my friends joke about it all the time. We try very hard to break from it but its really hard.
On a serious note I agree one should live life to the fullest but I think there is a balance.
Money is not everything but one shouldn't go bankrupt or end up in foreclosure trying to live life to the fullest.
I know those desis who are super savers and will never improve life style and I know those who are always on the edge of bankruptcy because they wanted to live the american dream.
I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.

Now a general question : for kids of 5 or 8 year old, the application should have their 'thumb print', right? It does say "thumb print of applicant or legal guardian", but I see no value in signing for them - there's no way to identify the child if I sign there... Or am I missing something why it's better for me to sign? (There's two places for signature/thumb-print : to sign for the application, and also at the 'specimen signature' spot).
I asked my 6 year old son to write his name..he wrote in big fonts..they accepted it and pasted below his photograph in the passport.

Not everyone is getting approved. I am still waiting.
I'm also still waiting. I don't know why but everybody getting emails at the same time, around 10 - 11 PM EST. It was not used to be like this before. We used to see approvals during the day also last year. They must have changed the way how their notification system works

Till early part of 2004 or latter part of 2003, most of the Indians applied EB3 very few applied EB2. After 2004, it was reverse. I doubt any one appled EB3 in 2005 0r 2006.
If EB3 stays continously in 2001 and EB2 in 2004 (there is 3 year difference in cutoff date between EB2 and EB3 now), the guys with EB3 PD 2002 and 2003 will convert to EB2 by applying new 140 to transfer PD. This flow will balance the cut-off dates. Eventually it will reach a common ground or a break-even point.
I doubt that people try to change from EB3 to EB2 , given the fact that they need get I140 approval which is taking more than 14 months and USCIS announced recently that, they are not bringing back I140 PP in the near future.

If you think any fraud is going on or there is a law being misused you must complain to USCIS and Ombudsman. Unless it is reported nobody in a position of power will know about it and nothing will be done to stop it.
I will try to explain the process it takes to get qualified for EB1C.
You will need to be outside USA for an year working as an Executive or manager. Come back to USA in that role. So the appropriate visa will be L1A. Most Indian companies require atleast 5-6 years of experience before they look at your resume for a manager. Most of the managers now a days get fired if their targets are not met in couple of quarters. So staying in that position for couple of years it self is a big deal. Now they need to prove the candiate valid for L1A position. Face a visa interview and come here and start working. Even if the same company is sponsering the L1A. Compaines usually wait for an year or two before they file I140. This application wll rot in CIS queue for long enough before they get a decision and GC.
This is the actual process.. If some company works in an apartment in India with one man show and tries to get an L1A, I am not sure if they will get through and get a VISA??? It is quite common that we have more EB1Cs becos, the number of Desi companies have grown. So if you think you are experienced and want to give a shot, try it. These kind of complaints in a longer run will bite us by delaying the applications and building backlogs..

I am one of those guys who beleives everything happens for a purpose. I think voting on these ammendments took place for a purpose. Since the ammendments are already agreed to they can be attached easily to any other bill now. Like appropriations or even AgJobs bill.....

I e-field on June 13th. So it is a little less than 90 days before my current EAD expires.
