I have got this response from Congressional Liaison, when I asked them for Update on my case whether I have to wiat till Oct or not based on the recent update on visa bulletin.
They Sent me This Email:
Your I-485 received on 5/21/07 and the Southern Service Center(TSC) is working these types of applications filed 9/11/06. They received your biometrics from the ASC 6/13/07 and the case has been assigned to an Adjudicating Officer for review. But, by the processing times, you still has a little time to wait.
Couple of question: They received your biometrics from the ASC 6/13/07 : Is this mean my FBI and Name Check cleared : I did my FP on same day?

A good friend of mine is getting divorced with her husband. The husband is the primary employment based green card applicant and their dates are current.
Will her I-485 be denied after the divorce?
The husband is willing to wait till the green card is approved before the divorce.

Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

If you have e-mails that's good enough. No need to be scared, if you feel that you have not done anything illegal there is nothing to be afraid of. If your prev. employer starts to threaten in any way play it smart and try and get him to write e-mails, you can use that against him. Always consult a lawyer first to discuss the pro's and cons.

My wife went to US consulate in Kuwait for her H4 stamping on Feb 18th. During the interview she was informed that some administrative process on their end was not completed and asked to pay for the DHL service and was told that she would be contacted by DHL who would collect her passport, get the visa stamped and return it to her. She was also told that it should not take more than 2 weeks.. On her application form, the interviewer wrote NO PIM.
Since then it has been a harrowing time for us. It has been 6 weeks, since then and we still have not heard anything. We have tried contacting the consulate using phone, email and at times my wife personally went to the consulate but she was not allowed to enter. We do not hear anything back from them.
I can understand a couple of weeks, but now its more than 6 weeks and counting. We have already cancelled her and my son's flight tickets once. We have rescheduled my son's doctor's appointment. This delay is having a domino effect on our lives.
My question is - Is there anything that we can do to expedite this process.

Is my perm valid if I am out the US without H1 B status? OR
Can I get H1B extension if my perm & I 140 get approved when I am out of the US without H1B status?
Here is my situation:
-My I140/I485 got denied -- in Aug 2009
-I got 9th H1B extension which is valid till Apr 2010
(As I know after Apr 2010 that I am not eligible to get extensions)

Hi,
My company applied for my H1B extn and after 3 months the status got changed to RFE... when the company lawyers recieved the letter, they reviewed it and emailed me the text below....
"Our office just received the Request for Additional Evidence from CIS by mail. What they requested in the letter is not applicable to your case and we believe CIS issued this RFE by mistake. We will respond to CIS to clarify this issue and will keep you informed if there is any update."
I have requested my company lawyers on the specifics...
Is it even possible to get an RFE by mistake? - (may be - yes)

One other question. CAn I submit a query to DOL and find the status of it. Are employees allowed to do that. I remeber sending them email a while ago, and they never replied. if there is a method of obtaining this information, can somebody pleae direct me to that.

I had filed my 485 during the VB fiasco, but did not file for ead/ap, as my H1 was valid. I intend to apply now but not sure what the filing fee is? Can one of you guys who might have filed later guide me on what the fee amount is and the documents that need to go with it. Is Efiling an option?
USCIS website says $340 for the EAD and $304 for AP, but I guess it is the new fee and does not apply to folks who had their AOS filed before July 30, 07.

If the form specifically asks for wage/week then I believe the correct response should be in that unit. I think your lawyer is wrong here to put your annual income there. But what do I know.....I am not an attorney.
This item deals with "Wage per week " in this field after i checked out my application lawyer gave the whole years income instead of weeks income. as i enquired he said even though "/year" is ideal to mention immigration officers know that this amount is same as that of Labor and thats not an issue . any comments please?

You cannot. They only deal with your employer or its atterney in your case.
