Last year I sent both the ITIN form and 1040 to the ITIN address. Once the ITIN is processed, they will update your 1040 with the ITIN number and forward it to the respective department for processing. I got my refund back after 8 weeks. Since I am in Texas I didnt have to file for state taxes..So not sure about the state tax filing part....

Or, two, deport everyone who had the courage to try to make it in America, even without a visa or status. Keep legal immigration restricted and strangle the economy, innovation, and motivation. Create fear and panic in immigrant communities, both legal and undocumented. Unmotivate immigrant youth to excel in school. Do everything in your power to cause distrust of lawful enforcement authority in immigrant communities.
These are your choices Congress. These are your choices Mr. President. Which will you have the courage to pursue and change?

Does it always go to consular processing for 2nd option?
I was more inclined towards 2nd option thinking that whether or not I get I94, if in case I have to use it, I can make a trip to India and get the stamping done?

Hello,
I think there is no such way to maintain H4 status legally if you shift on to EAD.
The only possible ways in your case if you shift to EAD is
i) Change the status of your wife to F1(STUDENT VISA) so that she can study or
ii) If she finds any sponsor go for H1(so that she can work).

I joined my present company in June 2004 on CPT, missed the summer graduation so applied for the spring graduation. Got my MS diploma in Dec 2004 (non thesis). Went on H1 in Oct 2004. Applied for GC in Feb 06 as EB2 and I got it without any issues. I know another friend of mine who joined with me in June 2004. He actually took classes later to finish his MS and finally graduated in December 2005 and he too got his Eb2 approved. The GC is for future job and not the current one so according to me it should be fine.

After so many mails my lawyer said that they have applied for my LC on 06/25. After 15 emails, she replied that LC applied means it is still in advertisement phase ... oops .. They had my papers and all forms with them since Mar'07.
This they are not really confirming that where they have advertised and for which category (EB2 or EB3)..

you can file for a change of status to H-1, but you cannot begin working until the change of status is approved. Alternatively, you can travel to a US Consul, obtain an H-1 visa, re-enter the US using the H-1 visa and then begin work.

While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

i won the DV lottery last year and am waiting to be called
as they lottery notification papers tell you - continue with all other immigration petitions.
the petitions are completely separate - take the GC with the petition that is adjudicated first and that's what I plan to do.

The first I -797 notice that I got, states that they received my I-485 application on July 16, 2007. On the website for USCIS status update, it states that they received my application on September 8, 2007.
According to my understanding, one does not have to submit the $340 application fee for a work permit if they received the notice AFTER July 30, 2007. This is where it gets confusing.
Here's the problem...if they say on my paper notice that they received the application on July 16, 2007, then I would have to pay the $340.00 - correct?
But if the website states that they received it on September 8, 2007, then I would not have to pay the fee.
I need a job, plain and simple. I have been in this country for 6 years and have not had a single paycheck. I get room and board for taking care of an elderly disabled person and that's it. Any money I do get is from the kindness of friends and family or maybe babysitting for a friend etc.
I cannot afford the fee, but I don't want to take the time to fill out and submit the application if I have to pay.
How do I determine which notice to follow? Should I assume I have to pay the $340 and try to do so by borrowing the money from someone and if it wasn't necessary will they give it back? Or do I just go ahead and submit the application without the money and hope it gets approved? Does a work permit usually get approved or am I wasting my time?

So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??
And if the LCA is denied because the DOL doesn't recognize the FEIN what options have we got..Can the employer reapply for LCA or just submit the Info and wait for info from DOL ??
