The House voted Sunday night on the Senate bill for health care reform, passing it 219 to 212. President Obama won a historic victory in the struggle for health care reform Sunday as the House of Representatives passed a sweeping bill overhauling the American medical system. What does this mean for Immigration? Big hope for the future, but a lot of work remains to be done.
Tens of thousands of people turned out on Washington's National Mall on Sunday to support the Obama administration in its next big battle, a renewed effort to overhaul U.S. immigration laws.
Speaking by video to the crowd, President Obama said he would do "everything in my power" to get a bipartisan deal within the year.
"You know as well as I do that this won't be easy, and it won't happen overnight," Obama said. "But if we work together across ethnic, state and party lines, we can build a future worthy of our history as a nation of immigrants and a nation of laws."
Though overshadowed by the historic debate on health care taking place in the nearby halls of Congress, Sunday's rally set the stage for a revival of efforts to reshape U.S. immigration law. The issue has been largely sidelined since a similar push by the Bush administration failed in 2007. We do hope that something will change very soon.

Here are few pending immigration bills which have a higher chances of passing in both house and senate. I was looking at some of the bills and noticed when a bill (or a varient )is introduced in both houses simultaneously the chances of that bill passing are higher.
This may be a good idea for us to try pushing some of the EB related measures if we can
into these bills. I know someone may say Hey these are family related bills But remember how they add the immigration, healthcare, veteran measures into budget or appropriation bills.....similarly we can try.

Use a good lawyer who can help with interpretation. USCIS has been flexible about the "same or similar" job thing , unless the jobs are entirely in a different occupation.

Hello,
My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.
Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

Actually how could the employer pay him before his visa status is activated. His visa status is activated only on 1st of october. and his status was changing from h4 to h1.

Hi,
My I-140 is pending, and my H1B renewal is also pending. Can I travel to India? If yes, what will I show as proof at re-entry?
How will it be for my wife? She is on F1 going on to OPT and a pending I-485 linked to my I-140 application.

I suggest you do premium processing of H1 extension or wait until approval. As far as your wife is concerned, I am not clear if she has a visa stamp. If not she can enter on AP.

TSC immigration officers answering phones at TSC are giving different status messages for the same candidate. The most commonly used answers are:
(1) Your finger print's are not uploaded to the TSC system.
Which is incorrect as the applicants went to their Infopass appointment and came to know there finger prints are done and after the applicants called FBI to confirm that the finger print results have been sent back to USCIS
(2) Name check not completed
(3) Visa number will not be allocated till october
The worst part is when you call the IO's after 10 minutes they give a different answer. The answers vary depend on the day and time of the call.
This has been goign on as per discussions in immigration forum @ http://boards.immigration.com/forumdisplay.php?f=98

I was in similar situation during 2006. I applied for H1 1 year extension based on PERM approval. My LC was just 1 month old . Then premium processed my I-140, once I had my I-140, I then premium processed my H1 extension based on approved I-140. Finally got 3 year extension.

To all IV members and the core team:
Thanks a bunch for mobilizing members to get their voices heard - first at the historic San Jose rally of high-skilled legal immigrants, and now with this monumental effort in DC on September 18th.
Thanks to all your efforts (myself included), we were able to file for Adjustment of Status (AOS), EAD and AP in July, and had the extension till August 17th to file it for those of us who couldn't do it sooner.
Thanks also to the lawmaker(s), and others who voiced their opinions and drew attention to the plight of highly educated, skilled, tax-paying, brilliant, and entrepreneurial folks, waiting for their GCs for as long as a decade.
We finally received our EADs yesterday, and our APs have been approved (awaiting notices).
The road from here to finally becoming permanent residents and perhaps eventually citizens of this great country (for those of us who wish to) is a long, winding one, full of tricky situations, significant risks, and the inevitable delays by the agencies concerned.
We all need to collectively make our voices heard, tell the lawmakers, the media, and the world about our lives that we continue living in limbo, and will be forced to do so for a long long time if we don't act.
I WILL ENTHUSIASTICALLY JOIN THE DC RALLY NEXT WEEK.

My situation is that Lawyer says I-485 appl. was hand delivered to INS at Nebraska on July 2nd morn. They had sent about 300 appls. July 2nd that way to avoid the change of dates fiasco etc.
Now, his office says that INS has not given any receipt for the delivery or acceptance of the hand delivered packages and there is no way to get a receipt etc. until checks are cleared. Since there is no tracking # etc. from fedex we are in the dark about the acceptance situation. According to him none of the packets have been returned either.
Is there anyone else in a similar situation?

Dear Sir/Mam,
I am presently working in India. My wife is getting an L1 visa approval petition. We need to go to the US consulate for visa stamping.
My question is that 1) Do I need to resign from my current job to get a L2 visa stamping on my passport? 2) If not required, do I need to carry any form or letter from the company that I am on long leave/vacation to show it to the US consulate officier?
Please advice.

You don't need to quit your job nor show any documents on extended leave to get a visa. Since your wife is the primary applicant, you just need to show proof that you both are still under bonafide marriage. Obviously, you will have to quit or take extended leave when you intend to travel to US but nothing to get a visa.

My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.
