    My wife is on H4 and with recent events, we applied for EAD. Our EAD was approved a month ago. I recieved mine but my wife did not. When checked with USCIS, they informed I have to wait for 30 days.

    It would be great if the group can share thier experiances or has any advise on this issue?

    Hi, My H1B on passport is expiring in mid Jan 2008. Similarly, I-94 is also expiring same time. I applied AOS in last week of July and hoping that I will get EAD by Dec but if it does not come by then, what are my options ? If I apply H1 in first week of Jan , would that be okay as I will have expired H1B stamp and I-94 in my passport. Please advise.

    Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...

    Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.

    Eventually my company received the Labor papers on May 7th 07....

    Hope this story helps.

    How long on average does it take to get labor approval into my lawyers' hands from BEC once it is approved (certified status shown on the BEC website).

    They do (3 years old info). Make sure you ahve all the documents that are mentioned in their checklist. They will give you the visa with the expiry date based on your I-94.

    LCA(H1B) is for the Company and not for the Employee.

    If you check your LCA your name will not be there anywhere.

    It just gives
    1.Location
    2.Wage
    3.Date.

    I think you should be fine..

    I am so sorry for what you must be going through. There are certain visas/immigration law provisions to assist victims of violent crime.     With respect to your first query, as an applicant for AOS you will retain legal immigration status even if you engage in non-H-1B employment using an EAD. You will, however, lose "lawful non-immigrant (H-1B) status" if you perform work for any entity that has not petitioned for H-1B status on your behalf.

    Keep in mind that merely applying for and obtaining an EAD has NO impact on your lawful H-1B status. So, given life's uncertainties, it's generally a good idea to obtain EAD and Advance Parole just in case H-1B employment is lost.

    Hello,

    Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.

    If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.

    How your husband file H1B for you ?
    Did he own a company ?.
    Did he file your H1B using desi body shops? without interview or knowing you ?!!!!!!!!!!!!!!!!
    Are you start working for the company?
    Your H1B start date is October 1, 2009.
    Your H1B approval notice does not have I-94 attached, because you are not applied H1B while in USA. So you need to go back to home country to get visa stamped and start working in H1B ASAP.

    Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.

    But when he filed my h1b i was in india.
    i came to us on June 2009 on H4 visa.

    can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.

    Visa recapture requires legislation. Unfortunately (or should I say fortunately?)USCIS is not in tthat business.
