Let me guess. You have a friend or a relative in the H1 que. And this H1 applicant is either getting education in US or is not going to be an employee of a consulting firm.
No. You got me wrong. I have friends filing through consulting firms. You got me wrong completly. Outsourcing/offshoring firms are completely different from Consulting firms. Consulting firms files new h1s and get the people here to work for their clients. This is good to new prople who wants to come here legally, to US busincsses and to everybody (except for anti-immigrants). But Outsourcing/offshoring firms file lot of H1s and do not use them. Thats the problem. If they use, it is not going to be a problem.

This is also wrong. I don't have any US degree. Also, I am working as Consultant from past 3 years. I worked with different big clients as a conultant. This is how it works in US. Again, Consultancy is different from Outsourcing/offshoring.

Samethng might happen even now if Congress increases it to 200K. Since we have less visas, everybody tries to grab a slot, But if we have enough visas (200K cap), then nobody is in a hurry to apply like the one happened this year.

It looks like you are aware of some USCIS internal policy that is not known to all. I used to think that the policy was based on the per country quota for each category. Maybe you can enlighten us all. What is the acceptable gap in PDs between EB2 and EB3 for AOS approvals? In your example it seems to be less than 4 years. Can someone with a PD of 2005 (EB2) get approved before another person with a PD of 2001 (EB3). Since you seem to understand the policy so well, could you please explain it in detail with specifics?

I agree with you that this isn't just fair to people who are stuck in DOL. People who have been waiting for years together will continue waiting while people who got their PERM approved as recently as this year will file for 485. Where is the justice in this? I guess DOS & USCIS have no clue what they are doing as far as the PD's are considered. Couple of months back they had retrogressed as far as 2001 (EB3) & 2003 (EB2) and now they have all become current. How can this possibly happen?
Few of my friends purchased pre-approved labors paying thousands of dollars (which I don't approve anyways) and now they feel cheated having wasted the money for nothing.
I am happy that at least the recent applicants do not have to go through the ordeal which most of the members of IV had to deal with for few years now. My sincere hope is that they value their GC as much as people who have been stuck in this backlogs. It would be a very ungrateful of them, if they think that getting GC's is a piece of cake and it can be obtained in a year. So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

Please note that the USCIS had already RECEIVED applications on the morning of July 2, 2007, even before DOS published this interim visa bulletin.
In my opinion it is an unfortunate decision in that it virtually renders null and void, thousands of properly filed Employment Based Green Card- Adjustment of Status applications.
An important thing to note here, is that in the Visa Bulletin published by DOS only 18 days ago (June 13, 2007) all Employment Based categories had been made �current� since almost 60000 immigrant visa numbers had been unused till that time.
This begs the question: how did USCIS manage to approve about 60000 green cards in less than 3 weeks, when it took the previous 8 months to approve the same number of green cards?
The Visa Bulletin published by DOS in June 2007, had brought good news to thousands of high-skilled temporary workers (doctors, engineers, IT professionals) in the USA, because the floodgates that had been closed for over 2 years had been re-opened.
This bulletin had implied that we could finally apply for "Adjustment of Status"- the final stage of the 3 step Employment based Green card process. This would solve a number of quality of life issues for people like me, as they would allow our spouses to take up part or full time jobs, they would bring in an element of stability allowing me to plan the purchase of a new home, and it would give me the freedom of relocating to another part of the USA for any unforeseen reason, without worrying about the portability of my existing job.
Therefore, my family and I worked really hard, and tried to religiously comply with all procedures laid out and submitted our application to reach the USCIS on the morning of July 2, 2007.
Besides running around to gather the paperwork to help file in time, I had to spend a significant amount of money on:
1) Urgent medical examinations and vaccinations by USCIS approved surgeon: $700. (Note: These were not covered by my medical insurance.)
2) New passport photographs; these needed to be less than a month old... so these had to be newly taken photographs
3) Notarization/ Courier charges: Approximately $100 (Some amount expended in foreign currency)
All of the money spent, as well as the time and efforts were rendered useless by the new bulletin on July 2, 2007, which I repeat, was published AFTER the window opened for new applications on the morning of July 2, 2007.

I have noticed that a lot of stocks that are worthless are pumped and picked by phony sites ....You might even be recieving spam emails asking you to watch certain trades.
Put them on a separate watch list since most of them usually spike for a bit and settle down ...What a DT does intelligently is to watch the spike and "Short" it when it starts sliding back again
This needs a lot of patience to learn and experience...so I suggest you not to trade in them for now and watch the plays.
Day Trading is like riding a bicycle , I believe , When you dont know how to ride it , even a straight road looks like a uphill task but as you learn and have more control over yourself....You start riding and with experience also know how to avoid the pot holes but most importantly how to get out and balance your self if you ever do land on it.
And then there are the ones who do Stunt tricks like Wheelies and back riding .......Thats what attracts novice to riding but you cant do that the first day Can You ???

Congratulations, you all are maing very good points that will definiteily get our gcs pproved immiediately, if that's not wnough then lets start a fight over eb2 v/s eb3 even if that not enough then lets try demeaning each others posts or and finally if we thinkg our problem is still small then lets talk about Shah Rukh Khans being stuck for over an hour....I think doing all that will get us our gcs pretty soooon.... We are certified MORONS we never learn...
BTW is there really a law that disallows using unused visa number for a given fiscal year oafter the end of that fiscal year? If so where is it and how does it read like?

Based on the trend of the signups till now and our need for resources to make sure we push hard for our provisions, we have a target of 1000 signups in one month. Some of these signups will also be more than 20 ($100 and $50). This is a achieveable target and will keep us focussed on the lobbying effort and devote resources to go all out in the coming months. I and manish flew monday morning sept 17th on a short notice to attend 11:30AM appointment and then again at 3:30 PM with nagaraj.
We had 2 more appointments on 18th with NH senators.
All the meetings were great and one them exceeded 30 minute schedule to 50 minutes.
It was great to meet all the members like aman, jay, paskal, kanika, meenal, nagaraj, pappu, gopal etc.
Paskal: Where is my beer?
Gopal: "Don't shoot the messenger" in the situation room.
jay: Speech pointing fingure to capitol hill behind him. "We are here on offence".
Mike: Step1 to step 5 entertainment
These are some, but not all, of the memorable things in DC.
I really had to mention pappu seperately.
He is a dedicated person to this cause and needs special mention. I really enjoyed his company in the bus on our return journey to NH. We shooted all possible questions and got convincing answers.
Thanks again for the wonderful experience.

I e-filed on 2nd June at TSC and around 22nd June, I went for FP. I received CPO email yesterday. I had not seen any LUD after FP. I guess, calling USCIS helps so please keep calling and request them that you need EAD badly. I remember , a couple of days back when I was talking to an lady IO, she said, she can send a request to IO but there is no guarantee that it will help. I guess, that might have made difference. So I would strongly suggest to keep talking to them.
