My friend's wife just got her H1 receipt number and he wanted to know if she can travel out of the country (and return before October) without stamping and if there is any need to change the status on her passport/visa.

Immigration reform will not take place unless the lack of reform costs the government. Now, we all know that H1-Bs pay Social Security Tax and Medicare Tax. Also, according to the rules, we are not eligible for the benefits. Considering the average pay of a H1-B is $60000. This unfair tax amounts to about $2300 per/year/person. Now there are about 350,000 H1-B stuck in Labor for the past 2-3 years. The total amount in unfair tax is nearly
$2.4 BILLION!!! (I am being very conservative about this figure)
Maybe they will pay attention if a lawsuite is filed to recover these taxes..

I got the CPO email just now.. i'm not sure if it's because of the SR that my wife opened on Friday evening or it just happened without that.. but anyways it's a relief now.. i also see a lot of people getting cpo emails today.. btw, just curious, does the cpo stage come before "approved" status or after it?
now hope that i receive the card in time.. will post about its validity and start date once i receive it. (i'll be current for the month of September as my pd is july 06)

One more idea
For Those who had spent more than five years in the US paying Federal Taxes, are highly skilled (MS) in STEM fields and has been delayed due to name check or Backlog etc. 5 (or 3 yrs) period should be counted from the date of receipt of I-485. (They definately need to get GC before they can apply for citizenship, counting this period)

A person, leaving behind a car/home and going back to home country is not doing anything criminal. He is playing by the rule. Of course, these acts would shine on his/her credit report for a while.

I am surprised some of us are actually encouraging immigrants to contribute to the current housing crisis.
I don't really care how it works in America or the rest of the world but common sense tells me loan defaulting is criminal.
When I lend $1000 to a friend for a year with 10% interest, I expect $1100 back at the year end. If he cannot pay and runs away to another country, that makes him a criminal (and of course it makes me stupid).
Let's say I decide to be little smart and hold his $1200 laptop, as a security.
Now, if I get only $500 by selling it at the end of the year, he still owes me $600 and he should still face criminal charges, because effectively I have been robbed of that amount!

I strongly feel without gc one should not buy a house but I like parts of the current posting. Every member who is discussing this thread and thinks this bill has a chance, schedule a meetign with your lawmaker today so that you can discuss OVERALL IV provisions and get a specific response on whether they will support, co-sponsor and vote for this bill. That will give us a direct answer instead of us speculating on the thread for months together.
If we get 40-50 lawmaker meetings scheduled over the next 3-5 weeks, that itself will provide us with enough feedback to decide whether this bill is worth it or not.
The point I am trying to make is that IV core is here to guide us and support us with national level advocacy. Nothing is going to happen in Congress until the grass roots efforts pushes congressmen/congresswomen/senators to think about a bill. Us sitting here and requesting IV to take up a cause (without any grassroots effort to back it up) is NOT going to help.
Its only after meeting a lawmaker that we realize how Congress works. No one is waiting to fight our cause...we have to push for it and use the IV platform.
So the plan can be -
1) everyone here who is positive about this bill..schedule a lawmaker meeting. I volunteer to coordinate the list of lawmaker meetings scheduled.
2) create a googlegroup with list of people working on the initiative. Keep track of feedback from each meeting.
3) WIth the feedback from the 40-50 meetings, we will know if this bill has any steam. Even if not, we will at least have established a rapport with local lawmaker offices which can be used for other piecemeal legislations that come up.
4) Keep the list of lawmaker meeting volunteers open and growing so that we will eventually have a large group of grass-roots volunteers regularly working on lawmaker meetings. These folks can keep track of legislations (through the forum, coordinator) and immediately schedule grass-roots advocacy/meetings when needed.
We have to create a culture and a habit within the EB community of regularly meeting with lawmakers so that every one of our local lawmaker offices has our issues on their fingertips (even if they oppose us). merely coming to a forum and requesting iv core to do all they can, the day before a bill is to come to vote, is (for lack of other terms) plain stupid.

Myself and my spouse applied for EAD Renewal on 04/20/2010, sent to TSC by lawyer.
Got receipt by postal mail on 05/04/2010 and got email yesterday that oth EAD are approved.
Actually current EAD expires at end of July, but we did apply before as we were told so to avoid unexpected delays in approvals as lot of new things are happening in service centers.
Also this is related to Drivers License renewal and in some states many rules changed (eg VA MD,CA ). Many new security features are enclosed.
Previously , once we provide all documentation required immediately new DL with new expiration date is issued. Now a days , DL issue process has changed in many states. Finger prints are taken and DL with enhanced security features are being issued.
This whole process of issuing new DL is taking 2-4 weeks.
Would like to mention some things regarding application.
Our Attorney is very good one and has lot of patience. He will never take chance by sending partial paperwork or giving some information to saisfy us.
100 % professional.
Till now we applied for 3 EAD Renewals and couple of AP renewals
He always asks us to send documents as specified below to avoide any possible queries etc.
1. Copies of all EAD, Front and Back color copies.
2. Copies of EAD Mailer forms for which EAD are attached.
3. Copy of DL (Front, Back)
4. Copies of all H1B &H4
5. Copies of all Passports (32 pages - 1st page in color)
6. Copy of latest I94
7. 2 Recent PhotoGraphs
8. Check for $340.00 (Pay to oredr of Department Of Homeland Security).
Previously, as soon as checks are cashed there used to be Redceipt Numbers (Like SRC, LIN etc) on back. But not any more.
We need not worry whether receipt number is on back of encashed check or not.
Even though many of us are getting approvals in a month or so, please dont count on this. It will be safe and better for applicants to send renewal applications at least before 90 days. Probability is that we might lose a month or 2, but this is worth taking in to all things in to consideration.

Finally after the third "card production" email (June 23rd, July 15th, July 29th) i got the card today valid for one year. I efiled on April 27th. My PD is April 2006 EB2. So i guess thats why got only for one year.

weldon springs, follow my posts. you are right, TSC is doing a better job. look at my previous post, they even renewed my Ead from the date of expiry of the previous one, so that we dont pay money for nothing. my EAD got renewd in exactly 4 days..
I am feeling very envious of people having their applications processed at the TSC. TSC as seen by the examples above are renewing EAD in 2 weeks.
However, NSC is taking 2 months to process these EADs. There is a big difference between processing logic at NSC v/s TSC
I think the employee diversity at TSC is big compared to NSC. Therefore, people add their heart to work and processing is faster. In other words, Intent is pure. If you pay a higher fee for a service you get the return.
Contrast that with NSC. The employee diversity is poor. Employees are working just because it is a government job and their intentions are questionable, therefore a big lag in processing.
Hope the courts teach NSC a lesson, that nobody is above the law and they should be processing cases quickly as compared to their TSC counterparts. Hope somebody is listening.

I have run over 12 half marathons, 6 races in excess of 13.1 miles and 1 marathon and I learn't that a marathon is not for everyone - that is why we have included distances like 5K and 10 miles in our event list. This is a great opportunity to pursue a healthy lifestyle and in the process support IV's long term lobbying efforts. Lets not forget what IV has accomplished for us in the past 12 months (resolving the July 2 Fiasco, Multiple Year EAD).

Afterall Guest worker program was one of the highly publized event of Pres Bush's 2004 presidential campaign. Which helped him win the race. In Florida and few other states(and few other blue states).
Congressmen(house and senate) know they are at a greater risk of losing in an election year by not producing a bill than producing one that dissatisfies few conservaties.
Basically talks about election year politics on this bill.

I talked with my lawyer yesterday, was informed that American immigration lawyers association (AILA) is filing for a class action lawsuit against DOL. There has been about 40% cases that are getting audited in Atlanta center. But after replying to queries, the center is not responding on a timely basis. There is light at the end of the tunnel.:)

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them .
