This is the easiest and the least that anyone can do for themselves and their family.

This a good opportunity to make ourselves heard. If you have already written a letter, talk to one more person into writing it. We need numbers to back ourselves in front of lawmakers.

I already took Vonage world phone. I am happy with it. However, I happened to see somewhere in the thread about Lingo offering india calling even through the mobile. That had me give a second thought on switching over to Lingo.

However, when I read the fine print on the lingo site, it mentions you cannot call Mobile phones in India. This catch makes me go crazy. Can some one confirm how are they handling with this constraint. Is that still a good option to switch over vonage to lingo based on this single feature?

    Thoughts are welcome...

Can USCIS stop accepting applications mid month without any notice. From the posts above, it would seem so. Everywhere else, I hear USCIS will accept applications till July 31 (with respect to July bulletin).

    Any information????

I called the department of state, visa's section to enquire about this PIMS verification. They said that KCC handles it. When I called KCC they said they cannot check ahead of time

Folks who had delays in getting H1b stamped due to the PIMS system:

Can you look at your I-797 and see if there was an A number (something like A123 456 789) mentioned under the "Beneficiary" box?

I have A number ...I think that signifies AOS number or something...

    What is your point?

Don't know if anyone noticed but Mr. Emilio's statement nowhere indicates any acknowledgement of the hardships caused by the fiasco. If he (and USCIS) knows about "flowers", I am sure USCIS knows about the scramble, hardships and frustration caused by the fiasco. A simple acknowledgement through something like " ....while we regret unintended consequences of following our internal procedures, we have made arrangements to forward the flowers to ..." would have demonstrated leadership or honesty of intent which I guess is in short supply

I think he is trying to say if anybody needs flowers its our men in uniform and not us (USCIS). I hope I am wrong but thats my perspective. Have sent the flowers anyway ;)

The requirement for a transit visa to enter the UK is not a new requirement. They were introduced because a significant number of passengers decided to remain in the UK rather than simply transit.

Before they were introduced, passengers had the ability to remain in the UK for up to 24 hours, enter the UK, change airports etc (this is called TWOV or Transit Without Visa and still remains for applicable nationals).

The intent of the Transit Visa is to ensure that the passenger will be accepted by the third country.

There are still issues with passengers who hold transit visas with a stated intention of transitting the UK. Either they are not accepted by the transitting airline and are returned to the point of origin, or they simply claim "political assylum" when they land in the UK and then they become the responsibility of the British Government.

the previous transit visa was a reuqirement for those that wanted to leave the airport...hence the 24 hr period. i have no issue with that- just to clarify. i do appreciate what you point out - that people overstay.

the new avatar of the TV applies even to those that are simply changing gates- ie walking from one plane to another WITHOUT ever setting foot on UK soil. i know this because i have changed planes in LON in the past WITHOUT a transit visa. in some cases as the air india passengers have pointed out, you don't even change planes, you are offloaded and go through security, and then return to the same plane again...hey tell me why i should be harassed and pay 90 bucks X 3 for my family- not to mention traveling 300 miles because "personal appearance"s needed- just to climb back on the plane and continue a journey? how can i seek asylum or overstay without being on UK soil (the intl transit area in any airport before immigration is an intl zone) ?
as for the airline not accepting the passenger onwards, that is something all airlines determine at the point of departure these days, the americans do a pre screen at the airport to ensure no such hassles.
the previous version of the TV was perfectly fine, the current one, for me, is undue harassment, even if i have an AP i should go 300 miles to the nearest consulate to get one for the privilege of changing gates? sorry bud...don't see why. there are easier ways to go home, and if the ticket costs a 100 bucks more- hey that's just the TV fees anyway right?

I am thinking that we should do something like have IV attorneys look into this PIMS delas and we should may be do another letter campain? (strictly speaking, I know this cannot become an agenda item for IV).

If this trend with PIMS continues (which is what it looks like), sooner or later it may affect a lot of people on H1b month after month who are going for visa stamping. With priority dates retrogressed badly this will become another pain point.

Who in IV do we have to run this by?

    thx

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.

The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.

The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.

It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.

If one doesn't like transit policy of a country, just avoid that transit point, rather than putting curse on that country ( or try changing the policy of that country through democratic means, if one can ).

Let us call rumors as pure rumors, even if they are from individuals here on IV or from aila until the official agency release their report.

Let us step back a bit and analyse it with just common sense.

USCIS and whatever that other agency is, is not a fool to release a july bulletin and make everybody current. If they have made all categories current in the hope that they want to utilize all visa numbers then this is the height of stupidity. If that was their intent, they could have moved dates 2-3 months each month starting july till September.

They should have prepared themselves for the flood of applications starting july 1st, and that is the reason for suspending the premium processing.

Make PD's current and then goingback in just couple of weeks doesn't make sense at all.
If someone has done this in haste then i doubt the overal integrity of this organization and its continuity.

When i started the rumor of possible mid july retrogression, then that was based on the flood of applications that would go by july 2nd week. I am surprised that people are now talking monday or tuesday retrogression and a possible fresh bulleting from USCIS.

Who would know the fresh july bulletin updates from USCIS other than USCIS and why would they leak that information before hand?
    Why should we beleive aila?

Do an independent and individual assesment of this issue and go have a beer for the weekend.

I have just upgraded my existing Vonage plan from Premium to World plan without any cost. As few guys said earlier, I remember paying $0.89 per min for India call a decade back when I was a student here - really great to experience fruits of VoIP innovation :-)

For someone who has Vonage account and want to upgrade, they can login into vonage web account, goto Billing section and click on change current plan.

The real question is whether 2 files is ok with USCIS. Lawyers are giving different opinion on whether u can do it or not.

If u can file 2 sets, then do ead/ap on one.

They probably won't even look at my wife's 485 for a year. But I *think* that the EAD/ap should be under my wife's. Not sure though. I would like both asap.

    Dear Mr. Dobbs,

Today you have proved how low you can get. You have criticized H1/L1 numerous times before and today your show criticized O1 visa, which is popularly, know as elite visa. This visa category is created for persons with international fame such as Nobel laureate, international fame athletes, musicians and entertainers. Today your show criticized none other than famous soccer player David Beckham. David is a highly successful international soccer player and his stature is often compared with top ten soccer player in the history of soccer. such as Pele, Maradona, Becanbaire, Platini, Ronaldo, Zidan and others. He is coming to play for LA team not to snatch your American middle class job. On the contrary he is going to help local economy grow when fans will completely fill the seats of soccer stadiums all over the USA. Unlike football soccer is not a mainstream American sports and most of the match organizers face hard finical decision to organize large soccer events. Wherever David Beckham goes fans follow him and all those empty seats will be filled within no time. WHEN STADIAMS ARE COMPLETELY FILLED FOR A MAJOR SPORTING EVENT, IT IS THE LOCAL ECONOMY THAT GETS THE MAXIMUM BENEFIT. So in other words Mr. David Beckham is coming here not to snatch middle class American jobs but to create jobs for them. ITS THE ECONOMY STUPID.

If you really care for middle class Americans why dont you run for the President post? Can you make public statement of your annual income from your myopic shows, books sale and public appearances. If you really care so much for American middle class, let me ask you a very basic question. Can you show us one example where you have contributed to some organization that helps inner city kids (mostly blacks) improve job skills? Can you show us one example that you have motivated and convinced one high school drop out to go back to school and that kid followed your advice and went back to school?

There are people like Governor Swaznegar (an immigrant), Magic Johnson you are silently doing exactly just that. These fine gentlemen created and funded (still continuing) organizations that provide on going job related training to inner city kids in Chicago, New York and many large cities so that they become productive American citizens.

Come on Mr. Dobbs, show some character. Dont just make publicity stances. Change America and provide equal opportunity for all. As a first step just become a mentor of Big Bother & Big Sister organization ( it wont cost you a penny) and motivate a high school drop out (you may pick up a white kid because everybody knows you do not like other color) to go back to school. Present him on your show and make him as an example of how America is changing to face the challenges of globalization. The Americans are eager to see some character here. Come on Mr. Dobbs what are you waiting for!

. The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.

There is no ambiguity in law. The law is clear. One law (and one rule) should yield one interpretation. If someone interperting the languge of law differently; then that is their mistake. Thats what DOS was doing in between 2001 and 2006. This could be possible for them because no one was going after DOS. Now somehow they realized (or some affected applicants notified DOS). If the old practice is a result of correct interpretation of law, why they should change now? This is very high sensitive area; DOS might have not changed their practice without risk analysis. They should not care about how much retrogression in India; They should only care about implementing the law correctly, as becuase they are executive branch of government not legislative branch to worry about retrogression.

Could it be that the AILA is talking about the 4th category and AILF's Legal Action Center is seeking plaintiffs - mainly 4th category that got their applications rejected?

AILA Follow-up to Update on July Visa Availability

    From: AILA National
    Sent: Friday, June 29, 2007 5:48 PM
Subject: Follow-up to Update on July Visa Availability

Further to the email earlier today about July visa availability:

Several members have asked whether they should continue in their efforts to
file adjustment of status applications for employment-based cases. Of course
, this is a matter for each attorney's best judgment, but note that:

-It is not certain what day the revised Bulletin will be issued.

-It is possible that the revised bulletin will not issue at all--efforts to
stop this unprecedented action are being pursued.

-If you "front desk" the application, i.e. decide it is futile to file, and
a remedy opens up later, having submitted the applications may improve the
chances of utlizing whatever fix might be available.

-If you do submit the adjustments, be sure to use a method whereby you can
document delivery, and keep that documentation for each client.

-AILF's Legal Action Center is seeking plaintiffs with respect to both the
adjustment applications that were or are expected to be rejected for June
and the adjustment applications that are expected to be rejected in July. Go
to InfoNet Document # 07062975: http://www.aila.org/content/default.aspx?docid=22798 on InfoNet for the Potential Plaintiff Questionnaire and related FAQ.

We cannot predict now what will happen, but will continue to update the
    membership as developments occur.
