I am surprised to see the list compiled by Sanjay b that all the pendig applications are received in the same time frame and received by J. Barrett. Do you guys think this package of applications is mispalced or something?
CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.

1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

NO Matter how many people say "Take it easy" its simply not possible, you will have to be a superhuman to do that. Sure its stressfull but no more stressful than boarding your first flight to USA. no more stressful than attending 1st H1B interview at the consulate or your first client interview. So in the end, we have been through all the hurdles with most of us surviving 2001-2002 job markets and now is 2007.
The point is we have been through all that successfully and thats a BIG WIN. So we will be through this too, but not without stress. The day we decided to come to USA and until now we have been successful as we are resourceful and can improvise at a short notice and we will. We are shrewd individuals and We Will PREVAIL.

By the way read INA about this and let us all know if there are specific provisions regarding this " EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)"
There is no specific rule regarding "EB1-> older of ...", however, DoS made it clear in the Jun/Jul bulletin that the spill-over is given to the oldest first.
BTW: EB1->EB2/EB3 is actually in INA.

my lawyer is basically saying: if we get lucky then one gets approved and the other one can be withdrawn at that point; otherwise at some point USCIS is going to issue an RFE asking us to pick one of those two petitions and force us to withdraw one before they make a decision on the other. For now we are sitting tight, waiting to see what USCIS does.

If your so called L1 brothers are not helping us by going thru the process.. why the hell do we help them.. Over that, these suckers always try to push us down whenever they get a chance , as they just don't want to and cannot empathize with our situations. So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

If its mailed out today, then you are ok. Its the POSTMARKED date that is seen. So even if it reaches there in July, as long as it went OUT today, they will have to accept it under June's batch of applications coz it is postmarked in June (june 29).

I hope my attorney really mailed it as they told me yesterday "your appplication is in Fedex envelope already, to be sent out Friday morning for Monday delivery"
My problem is a little more complex than that. My lawyers kept telling me from Dec' 2003 that my LC was filed under EB-2 since I have a BS+5 ... When they filed I-140 last year which is still pending, they kept telling me it was under EB-2..... yesterday when I emailed to ask if my application was out, an associate told me that it was ready in the Fedex envelope and scheduled for pickup today morning and that they had kept it on hold because my PD was becoming current only on July 1st...
that was a surprise to me because I thought I was EB-2 and my date was current as of June 1st... she said she didn't know anything about that and that the lawyer had instructed her to put it on hold for shipping Friday morning....
May be some kind of confusion on her part.. otherwise why would they accept and start working on my case right after the june bulletin which was released in May..
Life is already so complex......
