take your i 485 application. There is a received date column and notice date column.
Date received is the date they received your application, notice date is the date they entered your application was entered into their system.

So, if someone with priority date of 08may2006 (eb2), but with a notice date of aug 30 2007 will get the green card earlier than someone with priority date of 20april2006 (eb2) with a notice date of sept 15.

    thank you

NewsFlash! DOS Expected to Revise July Visa Bulletin
    Posted Jun 29, 2007
    MurthyDotCom
We have received news from the American Immigration Lawyers Association (AILA) that they have reliable information that the July Visa Bulletin will be revised on Monday, July 2nd, or Tuesday, July 3rd. This Visa Bulletin is expected to retrogress many of the categories that were announced as being "Current" for July. It is expected that at least some of the categories will become completely "unavailable." The reason for this is that the USCIS apparently engaged in extraordinary efforts to approve cases in June, once there was some forward movement of the Visa Bulletin. They did this to try to avoid the tide of cases expected in July. Each green card approval uses one visa number. If the numbers are all used for the year, then the DOS will issue a revised Visa Bulletin reflecting "unavailable" in the particular category or categories.
    MurthyDotCom
    DOS Input
    MurthyDotCom
While there is no 100 percent assurance about this matter, we at the Murthy Law Firm were given a 95-98 percent confirmation of the expectation regarding the Visa Bulletin by a very reliable source. The most vulnerable categories, of course, are those that are typically the victims of retrogression: EB2 and EB3 for India, China, and (potentially) Mexico. If this unprecedented action should occur, it will mean is that the USCIS will reject I-485 cases based upon the anticipated Visa Bulletin revision, if it should, in fact indicate that visa numbers are not available in a particular category.
    MurthyDotCom
    Legal Fight Brewing
    MurthyDotCom
There is substantial legal wrangling ongoing because of the anticipation of this unprecedented occurrence. The American Immigration Law Foundation (AILF) has announced plans to file suit against the USCIS for any cases rejected due to a revised Visa Bulletin.
    MurthyDotCom
    Conclusion
    MurthyDotCom
It is difficult to formulate words in reaction to this matter. So, for the time being, we will let our clients and readers know that our full sympathies are with them, as they face yet another potential disappointment. We also let them know that we have been long-time supporters and contributors to AILF and we will fully do our part to fight what comes.

Till now I do not see any one voted up for this. It is very sad that our own community is not supporting this. If you are not able to search for it in change.gov, give the complete title and see.
Citizenship if you have lived legally in this Country for 10 years continuously (http://citizensbriefingbook.change.gov/ideas/viewIdea.apexp?id=087800000004wel)

Guys Vote... Vote ... for us, for our kids....

Great effort Saralayar. I just voted. Vote for this, everyone. This is the least we can do get on the radar. There are so many voices crying for attention --- please vote so that we may be heard.

    It is very easy:
    1. Go to http://citizensbriefingbook.change.gov/home
    2. Register, by clicking on "sign in to get started now" (very quick --- no email verification steps, etc.)
    3. Search for "Citizenship if you have lived legally in this Country for 10 years continuously" (without quotes), in the "find an issue you care about" search box
    4. Vote by clicking on the up arrow.

Post a quick comment as well. This way we will draw more attention to it.

Ron Gotcher Latest ' ImmInfo Newsletter' states clearly 485 denial is illegal

    ***********
CIS issuing illegal AOS denials based on I-140 revocations

Recently, the CIS has been issuing denials ofadjustment of status applications in cases where the applicant has an approved I-140, and an AOS application pending for more than 180 days, but the petitioning employer has attempted to revoke the approved I-140.
These denials are patently illegal. They violate both CIS policy and statutory law. Both statutory law and explicit CIS policy are clear on this subject: An employer may not revoke an approved I-140 petition after an adjustment of status application has
been pending for at least 180 days. While we have not seen denials of any of our cases, we have seen a number of such denials by applicants who have contacted our office to assist them with filing motions to reconsider. It is shocking that the CIS
continues to issue denials even after the first MTRs were submitted. They are issuing these denials with full knowledge that there is no legal basis for what they are doing and that their actions violate existing law.

Anyone who receives such a denial must file a motion to reconsider immediately. The CIS has said that they are processing MTRs within 60 days. If the MTR does not result in a reversal of the denial within 60 days, the applicant should proceed in US District Court immediately to see a reversal. Immediate action is necessary to prevent the accumulation of unlawful presence following the denial.

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. But once the teacher was out.....maan his ass was all red in the hostel, in the class.....just kept running away from every other fellow student.....

Good to see some initiatives on flower / call campaign.

Please, while sending flowers/ calling Congress members - fax the copy on what Alen Greenspan said few weeks back. Its VERY important they know about this - http://news.yahoo.com/s/nm/20080813/...y_greenspan_dc

I have said it before and will say it again - " Nothing else but ONLY 'current economy ' will make this bill pass ". To get enonomy back on track, they need to fix housing market first.

Here is a summary of the bills, their bill numbers and the Sections:

    Sen. Chuck Hagel's Bill (Section 202 of S. 1918)
-High-tech workers who have worked in the U.S. for 3 years would be allowed to adjust to permanent resident status without regard to the annual employment-based immigrant visa cap of 140,000.
-The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.

    McCain/Kennedy Bill (Sections 601 and 602 of S. 1033)
-Increases quota on EB immigrants to 290,000 to alleviate retrogression
-Recapture unused visas between 2001 and 2005
-Increase the per country limit from 7% to 10%

    Cornyn/Kyle Bill (Sections 1001 and 1002 of S. 1438)
-Recapture of the unused visas between 2001 through 2005
-Removal of diversity visa and reallocation of these. Since this is mentioned under EB, the implication seems to be reallocation to EB but am not sure.
-Increase of the country limit from 7% to 10%

It is understood that there would be a merging of these to make the final comprehensive immigration bill

    Hi,
This thread (forum as well)seems to be really enthusiatic abt the immigration reforms.
Keep it up! I am a new member to this forum who had been passively following the S1932 disaster on immigration.com forums.

Hopefully things may look better with the new bill sponsored by Arlen Specter.
The bill looks good but how do we know that it is this bill which will be discussed and not the other bills sponsored by senator hagel, mccain etc..
Question is even though this bill seems to be a consolidated effort of all the previous bills how can we be sure if this is the bill which will be discussed as part of immigration reforms in feb?
Also this does not have any clause for applying for I-485 before cut off date?
So the people who benefit through this bill are probably the Masters/Phd who can automatically adjust their status and the people who have not even applied for a GC ( since no labor cert required).

But for people who are stuck at their 1-140 waiting to apply for I-485 the only thing this bill helps is increasing the EB quota.
I am a EB-2 applicant (masters) and would strongly support this bill but i don't see how it helps EB-3 applicants as much unless we have the clause for applying for I-485 before cut off date.

Even though there is a draft available about this bill, what gets included and what does not, is all up for debate yet. So no one really knows how this bill will look like, come Feb. That is why we are in the effort to have as many proosals that benefit us , be included in the bill.

And for doing #3, the community must cooperate.
If you have noticed, IV has done various campaigns in the past, though results are not guaranteed, enough publicity and buzz has been created and now we have more people uniting.

It takes time for big things to happen.

Mountains can be moved only by motivation, in fact #1 and #2 can never move mountains.

in 1970s, America opened up green cards to doctors, engineers and chartered accountants from India. A lot of doctors migrated that time and after a while there was heavy resistance from local people but govt cannot stop people from coming, so they implemented harsh rules to appease locals. One such rule was, even if you are a professional - you cannot take a job offer without going through the employment exchange. And in the employment exchange the job they give does not necessarily be the job that you can do. This discouraged new people and many people went back though they had green cards because they did not want to ruin their careers. Everything was good till you land here and no one told u about this situation. People never realised it till it hit them hard and as usual our community is scared to rise and no unity and no one speaks the truth, everyone just painting a rosy picture that they are doing great.

So, I would only say "Don't look at the result", just keep doing the effort. Try to build trust among the community. In fact you will be surprised to see that it is easier talking to the govt to help you rather than talking to the many unmotivated people who want benefit but are not motivated to do something about it. Keep those people in mind and do somehing to change their minds and set an example.

    I second Chandu.

Look at this way.. We are not asking anything unfair or outrageous. All little provisions that makes our lives easier. Some are even basic human respect issues and involves trust. As highly skilled immigrants, we deserve this.

    Guys,
Have we contacted national newspapers New York Times,Washington Post ?

In effort to make legislators and people aware of legal immigration issues, we should take help of media. This would be most effective.

Hiring a lobbying firm to pursue our issues with legislators is a good idea but it should be accompanied with media awareness as well. This is money intensive project and it will take time to reach its target of 100k.We need some other channel of awareness open as well and we need to do that soon so that it has some effect on Feb bills.

People are not aware that we are going thru such long waits to get immigrate legally. This issue needs to be highlighted.

Lawmakers would listen to legal immigration issues if they read in leading newspapers NYT and Washington Post. These newspapers are very influential.

    Java,

We are working on it. Media coverage isn't easy and immediate. They check us out, and take their time to research facts before even considering.

    But the process has started.
If you know of any serious contacts that can help out, or have any suggestions about regional/local media pls send a note to info@immigrationVoice.org with "Media" as the subject, and it'll come to me

    Thanks

I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

what is the thoughts/advise of your lawyer on EAD status? Before H1 is available (if at all in your case) can you continue working on EAD?

Did you send email to CIS Ombudsman and explained your case? If you read this thread, his email address and guidance to send email are provided. Do this if you haven't done it so far.

On Friday, I got SMS from USCIS that my case is updated and I should check status online. I checked my email. I was happy :) to see an email from USCIS and opened it excitedly with butterfly in stomach. Well it said..

"Your Case Status: Request for Evidence

On September 10, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires...........

Looks like I have to wait more :D

I always use AMEX and I know they have a good service. Maybe that is the reason they don't accept AMEX. I also disputed the charges with my CC company and they just got back to me after a month. They require some kind of proof (which I have), but I know what they are going to say. Since the email from UK emb(ass)y clearly mention the amount of $184 and $276, they (CC company) will say the charges are correct. The trick is to catch someone at the emb(ass)y, but it will only work if their email's are working or someone out there will handle my voice mail message left on their answering machine. It is much easier for them to delete/ignore the message than to take pains to correct the situation. Remember, I am dealing with a useless govt. organization rather than a highly competitive private company.

You can take a printout from the UK emb(ass)y website showing the standard charges for Visa. I think if you print page from the following link , that will be good enough proof for CC company.
