WASHINGTON � The Senate has approved an amendment by Sen. Carl Levin, D-Mich., to improve oversight of the FBI National Name Check Program, which faces a substantial backlog. The program is used to run background checks on people applying for immigration benefits or seeking employment with the U.S. government, among many other purposes. Levin�s provision, which was included as an amendment to the Commerce, Justice, and Science (CJS) Fiscal Year 2008 Appropriations Bill, would require the FBI to report to Congress every year regarding progress made in improving the FBI�s system of processing background checks and automating investigative files.
�The background check program�s enormous backlog poses an unacceptable burden on people whose lives are on hold, and it also leads to a national security risk,� Levin said. �Approximately 31,000 cases have been pending for at least 33 months. If these individuals are a security threat, we must know that sooner rather than later.�
According to the U.S. Citizenship and Immigration Services (USCIS) Ombudsman�s 2007 Annual Report, there were 329,160 name check cases pending in May 2007, which is and increase of 93,358 over the previous year. Many immigrants who are applying for adjustment of status to legal permanent resident, naturalization, asylum, or a waiver end up waiting for months or years for the completion of the name check process.
In 2003, Robert J. Garrity, Jr., then Acting Assistant Director of the Records Management Division of the FBI stated before the House Committee on Government Reform that, �[t]he name check delays have significant consequences to FBI customers and stakeholders. The delays impede hiring or clearing skilled workers; completing government contracts; student enrollment, and�clearing requested visas for business visits to the United States. More importantly than all of the foregoing, these processing delays can also diminish counterterrorism effectiveness.�

On an unrelated note, is there anything to gain from writing to congressmen and asking them to check on the case when it is current?
What do you state in the letter while requesting them to check with USCIS? I remember some folks did write to their congressmen last year around June/july when they were current.

Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.
If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.
I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.

Thanks for the quick response, Logiclife. That makes perfect sense in your case. But as for me, where my attorney is pretty good and my employer was treating me well till now. Should I just let him file 485 for me and 485/EAD/AP for my wife? And can I file my EAD and AP on my own later? What are the consequences of doing that??

For me, its 1 and 3. I am sick of my company's lawfirm. They are slow and they always end up filing things late. I almost lost my driver's licence renewal in April due to their procrastination and slowness in apply for H1 extension. If they do the same thing in this, then dates can retrogress and window of opportunity closes.
Besides, I somehow feel that errors on forms are more likely when paralegals do your paperwork rather than you doing your paperwork.
I am planning to keep a backup of all paperwork to file on my own if the lawfirm fails to file it by the 7th or 8th July. I will fire them and tell them to back off and do this on my own. I think that if they cant burn the midnight oil and work overtime during such critical times, then they deserve to lose business and we deserve to take care of our problems.

We are in US for past 7 years in H1B. Since the priority dates are current now we are ready to file I485.
3 years back my wife's status went out of status for 7-8 months when my employer renewed the visa's they forgot to do H4 and we didn't noticed it.As soon as we found it our attorneys did the Amended H1 and got her H4 status back to current.Since then her status is current..will there be any issue because of that when we apply 1485,EAD for her.
Please let me know ...

Thus the GC journey of 9 years and 8 months ends. Currently no difference in life it makes. May be when i travel GC may be of more help. (no AP H1B stuff to worry about)

India has less 500 cases in April 2001 yet its PD is Apr 15 2001
This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.
I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.
For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.

people who try to make quick money in couple of years by investing in house is ............... It is better to go and try it out in Las Vegas how lucky you are in making money instead of trying it out in real estate market with the span of 1-2 years in mind.
Even if someone wants to make quick money, here are the few tips. Also these tips are tips and not guidelines.
0. Know your limits. If you earn 100K, your buying power by thumb rule is 300K. So on saferside start searching with the range of 250K-260K. VERY IMPORTANT RULE.
1. Check the rental cost where you live. Example if 2br apt is 1200, then try to limit your mortgage, taxes etc within 1500 assuming you buy at least 3br house.
2. Reverse calulate the down paymet you have to put by subsituting your monthly payment ( apartment rental cost in your area + house tax + $300). Calculate the % of down payment from the above formula.
If the down payment comes to 10-15%, then it is worth buying than renting in your area. If the down payment is above that, then try to meet it. In worst case put 20-30% down payment to keep your mortgage payment lower.
Again, the above information is based on my house search and analysis. Others might have different opinion. Please take it if it is worth for you otherwise just ignore it.
