USCIS has to work in FIFO process not RIRO(Random In Random Out)... So they can't send Receipt Notice to Aug 17th filer and then look for July 2nd filer. I sent my concern to congressmen?
    :)

I fully agree that USCIS should work FIFO, but "should" does not make that happen. Clearly USCIS is not equipped for FIFI when truck loads of applications arrive. We may complain now, but I believe we should give them additional 10 days they need (to make it 90 days). I am equally worried about my July 2 filing. Nevertheless, I wish and hope the congressman's intervention helps.

So USCIS will never see the flowers becoz they are boxed.. and they will never get delivered becoz they are being routed from the airport itself. No major news media covered the few deliveries at USCIS.. What was the point of the campaign again?

For those of you who is interested in one line Q/A

"Is the flower campaign working? Yes"

"Are we good enough with what we have done? Not 100%"

    What happened

We were at the loading dock by 10 30 am ( Delivery estimate was between 11 am and 1 pm) and DHL appeared to
have already delivered around 50 boxes once around 9 am. All the flowers we sent are boxed . The visuals will
be boxes and not flowers in the evening when the youtube video will be uploaded. UPS delivered nex. We got the
video of the whole delivery and so did the CNN-IBN/Voice of America folks. There were around 30 boxes or so from
UPS. Next Fedex delivered and there were around 10-15 boxes coming out. While we were doing the recording one of the
officers politely told us not to capture federal buildings and we told them that we were only capturing the delivery of
flowers. After this what ever truck was coming in, they were reversing and pushing back into the dock so that the
delivery cannot be taped. CNN-IBN reporter asked for permission to go inside the loading dock and she was promptly
denied any permission. Then We had a down pour for almost 20-30 minutes and we had to leave the place.
It appears that the S&H dept now knows that most of the flowers are being delivered by DHL/UPS/FEDEX, they are taking
care of the diversion at National airport it self.

In the future if any one wants to do a flower campaign, Please select 2 local florists
(only two florists, in that particular city) and have people call and place orders/online. That way
we can talk with 2 florists and track their delivery easily for picture/video. Every one who tried to call
FTD/proflowers had alot of trouble getting any thing out of them. Actually, we cant blame them because they
are not doing it locally, instead they are putting their orders via national carriers.

Where do we go from here

If people really want to go out and get the main stream media attention, DC is the perfect choice. How ever,Don't plan on a weekend. If we do it right, we could be live on TV and the whole country will ask whats going on, along with the law makers. That will offer a platform for solving the issue at its roots. If you really want to do this, Dont come up with reasons like I dont have time off for a day or I have a project due. I can understand if 1 or 2% of our active members say it, but when 98% of our active members say that I can understand what it is. May be its time we figure out whether we prefer anonymity and pontifical verbatim on the online forum to expressing our concern/disappointment openly. Do not get offended and start flaming me. Just my thoughts.

I want to move from reliance to airtel or trueroots before deciding on vonage. Can someone tell me as how good is airtel 1c/min offer? hows the quality to india and other countries?

    Thanks

I tried airtel and then moved back to Reliance and ReliableCalling. Airtel number wouldn't connect regularly. Reliance call quality is good but expensive. ReliableCalling is almost as good as reliance but 50% less expensive.

And now, proud subscriber of Vonage. Use ReliableCalling for that occasional call from cellphone.

I called the USCIS office today. I am on H1b and my spouse is here on H4. I am filling 485 under EB2..

They said clearly that we need to submit I 864 form for support, not I 134 which few people have mentioned in this forum so far..

    So I am going with I 864..

What part do you want interpreted? It says in plain simple english that it is wating to be assigned to an officer.

You can take an infopass to find out if your case is pre-adjudicated, prints/name check are clear.

    Hi ,
My priority date is March 26th 2006 and current for month of September.
I created a SR on 09/14 and got the following response today.

    "
Service records indicate that your application is pending and waiting assignment to an officer. You will be notified when a decision has been made or if additional information is needed. If you do not receive a decision or other notice of action from us within 60 days from the date of this letter, please contact customer service to complete another service request
    "

I would appreciate if someone can interpret the message.

Looks like Obmudsman office have acknowledged the problem. Just read this on their site

    ......
However, the Ombudsman understands that USCIS may deny the Form I-485 in cases of portability (the ability to change jobs) before first issuing a Notice of Intent to Deny in certain limited circumstances. These include, for example, where the beneficiary is ineligible for the benefits of the Form I-485 by statute, or the Form I-140 is withdrawn before the Form I-485 was pending for 180 days........

Once again a big Thank You to all of the volunteers behind this campaign.

Now that is interesting. I have never met any dishonest Japanese. It is like it is not in their culture to be dishonest but that is my experience. The most dishonest thing i have seen Japanese do is that they have hard time saying the word No. That can leave one with the impression of that they still are interested. Su you think they are leading on you and think it is dishonest.

W2's/tax returns are not part of the initial evidence USCIS requires to process your application but they may ask for it later if required

A lot of lawyers try to preempt a possible RFE by including "AS MUCH AS POSSIBLE" documentation. 3 years of tax returns prove nothing more than what 1 year of tax return would prove.

Also, having a tax return of 2004 doesnt prove that you were in status at all times during 2004. Tax return shows total income that includes salary, bonus, deductions etc, and even Einstein cant figure out the immigration status in 2004 and whether the candidate was in good status at all times just by looking at the tax return.

Some lawyers send many years' tax returns, thinking that it might pre-empt the RFEs. Some lawyers send only whats neccesary. I've heard that one of the lawyers in New York doesnt even send employer's letter. That means, basically nothing from the employer. And he too gets cases approved.

Overloading the USCIS with a heavy file, sending a ton of things in addition to what they expect, may be a good strategy if you believe that it might thwart a RFE (and the delay caused by RFE). However, sending too thick a bunch, would also make your case look like a "difficult" case. (my belief, I dont know but just common sense would indicate that thicker bigger files are complicated cases if you give it a first look). And what that means is that it will get delayed because the CIS ombudsman report has documented that officers tend to work easy cases first (get the low hanging fruit first) and beef up their performance statistics by doing more cases in less time. Therefore, the complicated bigger cases that should be work on first, instead get worked on last.

So think a little before sending USCIS 20 pounds of paperwork. More paperwork and overwhelming USCIS with documentation may not mean faster RFE-free processing. (Again, my belief - something to ponder about. But do what you think is right and what your lawyer tells you. I am not a lawyer).

I don't disagree with any of the statements.. It is totally personal decision for someone to donate or not.

I agree that there is no silver bullet in any analysis. It is a number crunching game.. What is important is follow-up after analysis, which is only possible with IV.

Dems want votes and more Hispanics
GOP want more temps since it is very good for business
Lawyers want more money so they are not interested in solutions. They are in it for money
Individuals want their greencard just in time and not worry about the guy right behind them..
tracker websites need traffic to get money from adds, so they don't want solution..

Thanks for your kind words, its people like you who motivate me to analyze the data and create interpretations for all of us. Believe me its all very simple but has been only possible with news, inputs, suggestions and critique from all its really teamwork. Only together we have been able to come to understand how best we can predict what the future holds for us. Nobody claims or guarantees for accuracy however we do try our best to give out the most up to date forecast. Many folks like and appreciate this and it brings traction and new members to IV. Nobody is discounting that advocacy is not important it really is important. However the characterization of freeloader by some is extremely unfortunate I would attribute it simply to their lack of understanding. VBKRIS its absolutely yours and IV prerogative to keep information in the Donor forum to respect hose who contribute financially, however in the internet age information travels very fast.

For those wanting to personalize it a little bit.

    The Honorable George W. Bush
    President of the United States
    The White House
    1600 Pennsylvania Avenue NW
    Washington, DC 20510

    Dear Mr. President:

I write today to urge you to fix America’s broken legal employment-based immigration system. Currently, more than 500,000 skilled individuals who contribute to the American economy through their hard work in high technology, scientific research, medicine and other fields find themselves trapped in a process that is hopelessly backlogged. If nothing is done, hundreds of thousands of immigrants will wait years or even decades in a process that was never intended to take so long. While comprehensive change will require legislative action, your administration can implement administrative remedies to improve America’s competitiveness, eliminate bureaucratic inefficiencies, and improve our quality of life.

    <insert personal blurb here>

Attracting and retaining the best and brightest minds from around the world is in America’s best interest. In February 2006, your Domestic Policy Council issued a report on the American Competitiveness Initiative that recognized the importance of employment-based immigration. The report stated:

“The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals.”

You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken.

Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department’s mission.

The greatest impact of the broken green card process is borne by the legal immigrants and their families. The more than half million highly-skilled legal immigrants already working productively in the United States find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs – even within the same employer – without starting the arduous immigration process over again, and subject to waits that grow longer and longer.

We implore you to exercise your authority to implement administratively these much-needed reforms.

    • Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.

    • Revise the administrative definition of “same or similar” to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.

    • Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

    • Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    • Allow visa revalidation in the United States.

    • Reinstate premium processing of Immigrant Petitions.

I urge you to implement these administrative remedies without delay. Action is urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

Thank you for your attention to this matter.

    Respectfully,

Why not an interim AP or ability to travel using Original AP receipt before the actual AP arrives? The AP issue does cause a lot of disruptions in planned vacations or also in cases of unplanned emergencies.

Sending my Letters today.. written and stamped up

He just introduced an immigration policy called OVERDUE and it would severely restrict legal employment based immigration..

The legislation would end immigration of extended family members of U.S. citizens and permanent residents, which has long been the basis of legal immigration. The bill would shrink to 5,200 a year the number of visas issued to foreign workers.

Its interesting that July 2nd apps have not been receipted yet. I made two applications (based on the same I-140 from TSC because of the July fiasco), one on July 2nd and one on July 19th.

You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

If I am not wrong, buffering wud be to take in new 485 applications, process them and keep them ready.

In that context, most of the applications till 07/07 have been preadjudicated, new buffer wud require dates to be pushed to 07/07 or later.

I would think they move to 07/07 first to see any missing demand to appear in the next month or two and then move significantly, if needed, in the final quarter!

Totally agree with you! This would be a fair deal. That how it should be done so let us do that. So when are going to implement this fair deal?
I think it would be fair to split the leftover numbers the same way they split whole year quota.

50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?

Company and their attorneys took their own time and sent the application out only today for Monday delivery... I kept on reminding them what USCIS did to EB-3 other workers.. but all for nothing....... they can just say 'oops sorry' and out lives are screwed!!!
