I filed a G28 to allow me to represent my wife. I did not use an attorney. If you are filing for more than one person then I think that a G28 is worth it. It is a trivial form.

after filing for I-485 on Jun 1. Also filing for EAD for self and 3 family members. EB3 Nov 2001. H1B stamped in visa valid till Oct 2008.
Do I need to wait for Receipt of Filing?
Cancellations charges ( USD 200 per ticket - 4 tickets) and new tickets (difference of 300 per ticket - 4 tickets) will cost a lot. Anyone else in similar situations? Anyone know something? Anything?

I hope I am totally wrong, but you never know.

�A developed country�s competitiveness now comes primarily from its capacity to innovate � the ability to create the new products and services that people want,� according to Curtis Carlson of the Silicon Valley research firm SRI International. Skilled immigrants are a vital source of America�s capacity to innovate.
The National Venture Capital Association reports that 1 in 4 publicly-trade companies that began with venture capital since 1990 had at least one immigrant founder. While the vast majority of employees at U.S. firms are Americans, when U.S. employers recruit on college campuses they find foreign nationals represent a high proportion of the graduates in key fields. In 2006, 73% of new electrical engineering Ph.D.s in the U.S. were granted to international students, according to the National Science Foundation, while in 2005, foreign nationals received 55 percent of electrical engineering master�s degrees and 42 percent of computer science master�s degrees.
H-1B temporary visas, which have been exhausted each of the past 5 fiscal years, only allow individuals to stay on a temporary basis, so an employment-based green card is necessary to stay here permanently. The separate quota for green cards for skilled immigrants is set at 140,000 a year (including dependents of the skilled immigrant). That quota has also been insufficient to meet demand, creating waits of 6 to 10 years for a green card.
The great uncertainty these waits create lead some to give up and leave the United States and others to not even begin the process. The current long waits �cause a reverse brain drain affecting American competitiveness and innovation,� according to Aman Kapoor, executive director of the group Immigration Voice. �At the same time, these green card backlogs create severe quality of life issues for the applicants and their families.�
Those who understand markets realize that there is no such thing as a fixed number of jobs, as critics of high skill immigration maintain. A 2008 National Foundation for American Policy (NFAP) study found that for every skilled foreign national requested (for H-1B visas) with the Department of Labor, U.S. technology companies increase their employment by 5 workers. Many U.S. executives confirm this experience at their firms. It can fix the labor certification process for skilled immigrants under which the U.S. Department of Labor (DOL) requires companies to engage in expensive and time-consuming advertisements to show no qualified Americans are available for certain jobs. Neither the law nor the original DOL regulations required such advertisements. Yet DOL is using its questionable authority to, among other things, audit thousands of green card cases from the nation�s largest immigration law firm, Fragomen, Del Rey, Bernsen & Loewy. The Fragomen firm has filed a lawsuit in U.S. District Court alleging DOL has exceeded its authority. Congressional oversight is warranted.

Does anyone know if vonage can be used as a phone card. Say if you want to make an international call from your cellphone using vonage account.
I dont think they have the calling facility with the reference to vonage account.....I have chatted with customer rep and he confirms me the same....this was few days back...not sure now...if any body has new info, update here.......

I would like to think that by now DOS combined with CIS probably have a good estimate of the spillovers based on historical trends, current demand, pre-adjudicated cases, existing I-140's and porting cases. Assuming they have this data and the current availability of visas including spillover for 2011 as someone pointed out they might take the dates out towards 2008-2009 possibly since the CP cases are also coming to a close. Hence they could open a 2 year window so that the pipeline can move consistently instead of opening the pipeline by making EB2 India / China Current and flooding the system causing endless delays.
I think most of us ignore the CP cases which DOS/ CIS has to ensure has a full workload possibly explaining the NVC updates of fee requests-
I would bet that whatever they do they will work together with CIS is to ensure that workload with CIS and consulates all around the world is maintained and if anything a smooth consistent pipeline is also established for the future- this is just a guess- most of it is anyways.
We will see....

I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruptiy on at various countries in the world and you can see where India ranks relative to US or UK

Employement based immigrants are just 17% of the total immigrants whereas family based immigrants are more than 50+ %. better target them. Don't waste your time since you won't get anything as everybody over here are working and US employers want them.
3. If you are unemployed, please spend your time in findiing a job. The minimum salary in US is around 8 dollars a hour so you have wasted your entire day. close to 100 dollars. You have not earned a thing by writing your thoughts in this forum.
4. Senator Grassley and Durbin are working on your side and they also like you don't want a google, yahoo, ebay and other firms to suceed iin US. Be prepare to immigrate to some other country in future.

1. Get a letter from Senators and Lawmakers, that those H1B guys who have contributed to the economy by filling patents and doing reseach should get out of the country. I will be the one to get out first.
2. Lean this, business are been done to make profits. Employers in this country think about themselves not about you. Check John Hanity show and they will teach you the fundamentals. If employers don't earn any profits they won't do a business.

I guess it may either be the SR that I opened for my wife or the letter I wrote to Napolitano...my wife got a call from a CSR from DC and she told that her case is pending because of the Biometrics, she said she is issuing new biometrics...the speaker phone was on...and I interjected...how come I got approved w/o the Biometrics...she was clueless...I told her how many times can Biometrics notice be issued...my attorney called TSC on 10th of Sept and that time a notice was issued which we never received and then again two weeks later someone else issued another notice.....then someone else told that Biom is fine it just needs uploading and it has been two weeks since then the only thing that is happening is the Visas getting used up .....I said what's the point of FP/Biom if visas are no longer available which surely will be the case in 3 weeks....
In any case didn't expect a phone call from them so was surprised.

I plan to talk to my lawyer today. My past experience is that lawyers don't give all the options themselves. You have to know what options you have and then they will give advice on that.

If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

Its very very critcal that this things pass..else..EB-3 jump ship to eb2..to SOS
It is unfortunate that people don't even try to understand the issue and just go about complaining it.
Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
Here are the my estimated waits for EB3-I
PD(end of the calendar year) and its corresponding wait in years
2001 1 year
2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years

It is unfortunate that people don't even try to understand the issue and just go about complaining it.
Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.

2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years
2007 12 years
